A major civil rights victory was won in the New York State Budget.
The language of my bill (A.9076A) the New York Civil Rights Act, creates a pathway for New Yorkers to bring claims in state court when federal government officials violate their constitutional rights.
New Yorkers have long been able to seek damages against state and local government officials who violate their rights. After passing this last budget with the language of A.9076A included we NOW can extend that principle to federal officials, ensuring there is a state court remedy when constitutional protections are violated.
As immigrant communities across New York face increasing fear and uncertainty, this legislation reaffirms a basic principle: constitutional rights must have meaningful remedies when they are violated.
I’m proud to have introduced this measure last year with and we now have it implemented in this year’s immigration package. I’m grateful to Senator Myrie, Govenor Hochul, the advocates, and legislative leadership and staff that fought so hard to make this a reality.
