The California Association of Resellers, ReUsers and Buyers (CARRB) is a non-profit organization that advocates for the rights of persons who buy and sell used goods excepting those who buy and/or sell in a pawn capacity. We are working to educate our legislators in regard to the types of used goods that are bought and sold at weekly/monthly markets and in brick & mortar establish
ments, and how and where these items are typically obtained for resale. It is our belief that applicable laws can be amended once our industry as a whole is better understood by our lawmakers. CARRB seeks to protect the right for individuals to conduct business in the secondhand goods trade without the burdensome parameters that are currently written in to law, but are largely unenforced. With the impending implementation of a statewide computerized database, local law enforcement agencies will be forced to hold secondhand dealers to the statute as it is written. Our goal, therefore, is to make sure that the laws that are in place accurately reflect our industry, and that the requirements of the law make it possible for buyers and sellers of secondhand goods to do business in a viable and compliant manner. These laws affect all persons and businesses that buy or sell used goods at indoor and outdoor markets, auctions, thrift and consignment stores, estate, garage and church sales as well as via the internet. Current law dictates that transactions concerning any second hand good(s) requires a photo ID and fingerprint from whom the good(s) are purchased, that a listing and full description of every item purchased be submitted to law enforcement by the end of the next business day following the purchase, and that a 30 day hold be placed on all items prior to reselling. These encumbrances make it impossible to maintain profitability for the business owner (Reseller), and create difficulty for law enforcement who are expected to track lists of copious amounts of low priced items - goods purchased often times from estate sales and thrift stores. It also discourages individuals from selling their goods to resellers due to the risk of identity theft when giving out their personal information. These requirements could very possibly shut down the various distribution channels of secondhand goods. If the flow of goods is halted due to these laws, most items would end up in landfills. Our motto is "Reselling is Recycling"; but in order for this to occur, our laws must make it feasible to do so. That buying and selling antiques and collectibles allows a significant number of Californians to make a living, and is also vital to carrying on the history and tradition of goods produced in past eras. In addition, that secondhand goods of all types help many families make ends meet, and that markets throughout the state of California give members of our communities vibrant and reasonably priced places to enjoy time with friends and family - while keeping valuable secondhand goods out of overstuffed landfills.
