"The child in this case is neither abandoned nor orphaned but has been legally relinquished into the care of the Petitioners by his biological parents. The court acknowledges the parents' inherent right to decide on the care and custody of their child. In this instance, the parents have exercised this right by voluntarily entrusting their child to the Petitioners, affirming their trust and confidence in the Petitioner's ability to provide care and support to him. Recognizing the parents' deliberate choice, the court finds it essential to honor and respect this decision". Per Justice Celia Nagawa (05 December, 2024).

"An adoption order is final and for life as regards to adopters, the natural parents, and the child. The child in this petition turns 18 years in a couple of days and granting this petition would mean creating a new parent and family for him separate from his brother and terminating his legal relationship with his biological father whom he has known in his childhood. He will lose his family tie...For that reason, I do not find it in the best interest of the child to grant him this adoption a few days before he attains majority age (adulthood)". Three petitions completed! Great work!

On 12th February, 2024 the High Court (Family Division) declined to grant an adoption for a child that was almost clocking 18 years. The court was of the view that the adoption was not in his best interests!

We will be handling almost a similar case. I hope the circumstances of the child and the prospective adoptive parent will be sufficient for the grant of an adoption order. We are ready for the challenge!
