The Marriage Bill, 2024 aims to reform and consolidate the law relating to marriage and divorce with the introduction of a significant reform on matrimonial property rights.

The bill references key case laws such as Ambayo v. Aserua where the court emphasized that ownership of matrimonial property is determined by the contributions of both parties.

The court also emphasized that upon dissolution of a marriage or separation, property division follows the principle of equity considering both monetary and non-monetary contributions.

Women’s domestic contributions are valued in the same way as men’s financial contributions when determining the division of property.

With just five years remaining to assess the achievements of the Sustainable Development Goals (SDGs), today we focus specifically on SDG Goal 5(a), which addresses women’s Land Rights.

The SDGs are a set of 17 global objectives established by the United Nations in 2015. They aim at ending poverty, protecting the planet, and ensuring peace and prosperity for all by 2030.

Among these goals are Gender Equality, No Poverty and Zero Hunger.

Numerous international laws, regional conventions, treaties, instruments and frameworks have been developed to promote and protect women's land and property rights.

Uganda has made tremendous steps in domesticating these instruments by developing progressive and gender-responsive laws and policies to advance women's land rights.

However many people including rights holders, duty bearers and community members still have limited knowledge of these laws.

To address this, we have partnered with the Stand for Her Land Campaign, a global campaign that seeks to advance Women’s Land Rights coordinated by Uganda to educate, enhance legal literacy and raise public awareness about the existing legal frameworks and policies that protect women’s land rights.
