C-249/25 Jilin, ECLI:EU:C:2026:806.
EUR-Lex
NOS
DIP EUAA
DIP EUAA

⚖️ CJEU: temporary protection cannot be used to automatically “freeze” asylum applications
On 1 October 2026, the Court of Justice of the European Union delivered an important judgment in Case C-249/25 Jilin, ECLI:EU:C:2026:806.
The Court held that where a person benefits from temporary protection and has also lodged an application for international protection, a Member State cannot automatically suspend the examination of that application — or the time limit for taking a decision — for the entire duration of temporary protection.
In practical terms, a state cannot simply say:
“You already have temporary protection, so we will put your asylum application on hold and come back to it several years later, once temporary protection ends.”
The CJEU held that such an automatic practice is incompatible with EU law. EUR-Lex
🇳🇱 What does this mean for the Netherlands?
This is where the immediate practical impact may be particularly significant.
The Dutch system was organised in such a way that people displaced from Ukraine who obtained temporary protection also had asylum applications registered. Those applications were then effectively put on hold while temporary protection remained in force.
According to NOS, more than 140,000 asylum applications by Ukrainians have been parked in this way. Following the CJEU judgment, they cannot simply remain unexamined until temporary protection ends. The Dutch IND will have to organise their actual examination. NOS
This does not mean that 140,000 Ukrainians will automatically receive refugee status.
Every application still has to be assessed individually and may result in either a positive or a negative decision.
🇪🇺 What does the judgment mean for other EU countries?
This is not merely a Dutch case.
The CJEU interpreted EU law, which means that the principle established by the Court is relevant across the European Union wherever Member States apply comparable rules on temporary and international protection.
And similar mechanisms exist outside the Netherlands.
In Finland, once temporary protection is granted, the processing of an asylum application is generally suspended, subject to specified exceptions. DIP EUAA
In Belgium, a beneficiary of temporary protection may apply for international protection, but under the existing system examination of that application is suspended until the temporary-protection regime ends. DIP EUAA
In Germany, Section 32a of the Asylum Act (AsylG) expressly provides that an asylum procedure is suspended for as long as the person benefits from temporary protection under Section 24 of the Residence Act.
This is why Jilin may have consequences well beyond the Netherlands: national laws and administrative practices providing for automatic suspension will now have to be assessed in light of the CJEU’s interpretation of EU law.
The judgment does not mean that every pending asylum case across Europe must be decided immediately. EU asylum law allows procedural time limits and, in certain circumstances, lawful extensions. But a blanket rule saying “you have temporary protection, therefore we will not examine your asylum application until temporary protection ends” cannot simply be applied automatically.
The central principle is straightforward:
temporary protection cannot become years of legal uncertainty for a person who has already exercised the right to apply for international protection.
