The Ukrainian Arbitration Association is a non-profit NGO that brings together lawyers, regardless of their belonging to a particular jurisdiction, who are professionally engaged or interested in the practice of the disputes in the sphere of international arbitration. Membership in the Ukrainian Arbitration Association is open to all individuals possessing a law degree and having professional inte

rest in the international arbitration practice, as well as sharing the goal and objectives of the establishment of the Association. The main objectives of the Association is promotion of Ukraine and, in particular, Kyiv as a venue for international arbitration, providing assistance and support interest in the practice of international arbitration as a method of resolving of cross-border disputes, promotion of knowledge and experience in resolving disputes through international arbitration, as well as strengthening of cooperation and exchange of experience between the specialists from around the world. Moreover, it cooperates actively with the ICAC at CCI of Ukraine and other arbitration institutions, as well as similar associations dealing with the development and promotion of international arbitration practice. The Ukrainian Arbitration Association invites practitioners and individuals interested in the development of international arbitration practice, to cooperate actively as members and candidate members of the Association.

The Ukrainian Arbitration Association is happy to open registration for the Arbitration Academy, now in its III edition!

As previous editions, the III UAA Arbitration Academy will help a wider audience of Ukrainian lawyers and students, as well as representatives of business, to enhance their knowledge and skills in international arbitration through practical and interactive lectures and a round table. The goal is to prepare Ukrainians to effectively navigate the growing number of international disputes, including those arising during the war, as well as to negotiate dispute resolution clauses in new cross-border contracts and projects, including for Ukraine’s reconstruction. The III UAA Arbitration Academy is open to all Ukrainian citizens regardless of their place of residence. This course will be free of charge.

The faculty of the UAA Arbitration Academy will include prominent arbitration practitioners and academics from leading international law firms, universities and institutions, as well as independent arbitrators, providing valuable insights and expertise to Ukrainian participants.

The course will be taught online in English, divided into two parts with 40 hours of lectures in total:

• Module 1: Basic course | 8 September – 8 October 2026 | two-hour lectures on Tuesdays and Thursdays at 18:00 Kyiv time, 9 lectures and a round table

• Module 2: Specialised course | 13 October – 12 November 2026 | two-hour lectures on Tuesdays and Thursdays at 18:00 Kyiv time, 10 lectures

The curriculum encompasses fundamentals of international arbitration, from arbitration agreements to post-award proceedings, lectures on industry-specific arbitrations (e.g., construction, sports, maritime, commodity), as well as topical issues in arbitration (e.g., damages, third party funding, AI & modern technologies).

The III edition will feature a new specialised topic on interaction between arbitration and the EU law. It will also offer two new skill-oriented lectures on legal research in international arbitration and cross-examination of witnesses.

The Ukrainian Arbitration Association invites Ukrainian arbitration practitioners, academics, and in-house counsel to participate in a new survey launched by the International Chamber of Commerce focusing on the use of artificial intelligence in arbitration.

As AI tools continue to shape legal practice, the initiative seeks to capture current trends and practical experiences across the global arbitration community. The results are expected to contribute to a more informed discussion on the opportunities and challenges associated with AI in dispute resolution. Quoting the ICC:

"The survey aims to gain clearer insight into current AI practices within the arbitration community and to better understand how AI tools are being used in practice."

During Paris Arbitration Week, Ukrainian Arbitration Association together with K&L Gates France hosted a high-level panel discussion titled: "Ukraine in Focus: Investment in Post-War Recovery, Contracts, and Disputes." The event brought together international arbitrators, legal practitioners, and representatives from state energy giants to explore the legal frameworks essential for securing investments in Ukraine’s reconstruction, as well as the evolution of Ukraine’s legal and arbitration environment amidst the ongoing war.

The distinguished lineup featured: Serhii Uvarov, President of the UAA and Partner at IMPACTA LAW (Kyiv); Dr. Markiyan Malskyy, Board Member of the UAA and Managing Partner at Arzinger (Kyiv); Oleksandr Kushch, Head of International Dispute Resolution at NJSC Naftogaz of Ukraine; Georgiy Grabchak, Senior Counsel for International Disputes at PJSC Ukrnafta.

The discussion was moderated by Maria Kostytska (K&L Gates Paris partner and UAA Board Member). Louis Degos (Bâtonnier du Barreau de Paris (Ordre des avocats de Paris) delivered closing remarks.

Ukrainian Arbitration Association together with K&L Gates are pleased to invite you to join us for a panel on the legal and contractual landscape for foreign and domestic investment into Ukraine's post-war reconstruction during PAW 2026.

The speakers will cover:

- an update on the legal and arbitration landscape in Ukraine during the ongoing war;
- the latest legislative and regulatory changes regarding public-private partnerships and privatization;
- the current and evolving legal framework for production sharing agreements (PSAs), subsoil licenses, conversion of subsoil licenses into PSAs, joint ventures (JVs) with foreign companies;

If you want to stay sharp on post-M&A disputes and explore the broader geopolitical and legal implications of the Ukraine–United States mineral resources agreement, the Dispute Resolution in M&A Transactions - International Conference - is a great place to be. It is also one of the few conferences where the discussion is genuinely driven by practitioners and where the audience truly takes part.

On 13 February 2026, the UAA Working Group submitted to the Commercial Court of Cassation of the Supreme Court a collectively prepared independent expert opinion (Amicus Curiae Brief) in case No. 910/11283/25.

The Working Group considers that this case raises issues that are important for the development of arbitration in Ukraine and for shaping the perception of Ukraine as an arbitration-friendly jurisdiction. In this case, the Supreme Court will have the opportunity to opine on enforceability of the arbitration agreement that provides for ad hoc arbitration, as well as in particular on enforceability of such agreement where the mechanism for appointing arbitrators as agreed by the parties fails for any reason.

The Working Group hopes that this opinion will assist the Supreme Court in its consideration of the case.
