Many migrant workers, after being told by their employer to stay in the dormitory, unknowingly fall into the trap of “three consecutive days of absence without leave,” which can later become a legal reason for dismissal.

Key Points from the Program
1. Dismissal Must Have a Legal Reason
Employers cannot fire workers whenever they want.
Unless the employee has committed serious misconduct (such as being absent from work for three consecutive days without reason or seriously violating workplace rules), the dismissal is very likely illegal.
Even if the employer believes the worker’s performance is poor, the law generally requires the employer to first give the employee a chance to improve and provide guidance or training, rather than immediately firing them.
2. Beware of the “Three Days of Absence” Legal Trap
If a boss verbally says, “Don’t come tomorrow,” and the worker actually stops going to work without pay, the employer may later accuse the worker of being absent for three consecutive days and use this as a legal reason for termination.
How to protect yourself:
Even if you are denied entry to the workplace, you should clearly show your willingness to work by:
recording the conversation, or
sending a LINE message stating that you are willing to work.
This can help prove that the employer refused your labor, rather than you voluntarily skipping work.
