MINIMUM WAGES ORDER

Second Schedule - Overtime Wages For All Workers

1. For overtime worked beyond eight hours on a working day-
First four hours... one and a half times hourly rate
Second four hours... two times hourly rate
Thereafter... three times hourly rate

2. For overtime worked beyond ten hours on a working day of a four day shift week -
First four hours... one and a half times hourly rate
Second four hours... two times hourly rate
Thereafter... three times hourly rate

3. For overtime worked on a Sunday where Sunday is a normal working day-
First four hours... one and a half times hourly rate
Second four hours... two times hourly rate
Thereafter... three times hourly rate

4. For time worked on an off day-
First eight hours... two times hourly rate(40 hour work week)
Thereafter... three times hourly rate

5. For time worked on a Sunday is not a normal working day and on a public holiday -
First eight hours... two times hourly rate
Thereafter... three times hourly rate

6. For time worked beyond the forty hour work week -
First four hours... one and a half times hourly rate
Second four hours... two times hourly rate
Thereafter... three times hourly rate

The Minimum Wages Order applies to every worker who earns an hourly rate of one and a half times ($26.25) the minimum wage or less. This equates to 200,000 Minimum Wage Earners in Trinidad and Tobago. The law is clear. Join the National Security Officers' Union today and make your voices heard heard on this issue.

Meet Unprecepted Security Officer Joe. He's a dummy.

He's been employed with Above D Law Security for ten years. He's never gotten vacation leave, nor is he allowed sick leave. Last month he was charged $1000. for failure to report for duty (even though his pregnant wife was rushed to the hospital with pregnancy related complications). AND he actually called out two hours in advance to notify the sentry. He works seven days a week and his employer has threatened to fire him if he misses another duty. His employer refuses to pay overtime even though Officer Joe works an average of 168 hours per fortnight. His uniform costs $2000 (1 WHOLE extra shirt included). He just found out that his employer is deducting NIS but not making the contributions to NIB as required by law. He's being charged 50% interest on a company loan that he can't repay because he's currently owed 4 months salary by his unscrupulous employers, who continue to add interest to his loan.

All of this has left him on the brink of hopelessness, bankruptcy and homelessness.

Someone told him that the National Security Officers' Union could assist in rectifying his issues but he's "Glad to have ah wok and 'fraid to lose it" so he's content to go on with life as usual.

MINIMUM WAGES ORDER
Paid Vacation Leave

6. (1) A worker shall be entitled to two weeks vacation
leave with pay annually on completion of twelve months service
from the date of his employment subject to having worked a
minimum of two hundred and twenty days within that period.
(2) In the case of a part-time worker pay shall be
calculated on the basis of the average remuneration for the
preceding three months or the pay immediately preceding
vacation leave, whichever is the higher rate.
(3) Where a public holiday falls within the period of
vacation leave of a worker he shall be granted one additional
day’s leave with pay for every such public holiday.
(4) Where a worker becomes sick during his period of
vacation leave, then subject to clause 7 he shall be granted one
additional day’s leave with pay for every such day of sick leave
once the sick leave is certified by a medical practitioner.

Sick Leave

(1) A worker shall be entitled to fourteen working days
sick leave per year with pay subject to—
(a) his being continuously employed for a period of
at least six months; and
(b) his production of a medical certificate in respect
of any period of illness in excess of two days.
(2) Payment for sick leave shall amount to the
difference between a worker’s pay and his entitlement to sickness
benefit under the National Insurance Act.
