On 23 February 2026, Kwah Dao Foundation received a generous donation of 36,120 baht from Journey Into Oneself Pai Community together with students from QiGong TaiJi School (Pai Branch).
The donation will support Kwah Dao’s Scholarship and Student Loan Program, helping students from disadvantaged backgrounds continue their education. This amount can cover up to two semesters of university tuition and a one-year student visa extension.

Journey Into Oneself Pai Community promotes well-being through TaiJi, QiGong, GongFu, and meditation, while also actively supporting community development. The group has long contributed to ethnic minority families and remote schools in Pai District, and this donation marks an expansion of their support to Kwah Dao.

Kwah Dao sincerely thanks Journey Into Oneself Pai Community, its students, and especially Khun Ema and Khun Thomas for traveling to Chiang Mai to personally hand over the donation. Your kindness will help create meaningful educational opportunities for students in need.

ลุงเค (นามสมมุติ) ชายสูงอายุไร้สัญชาติที่ถูกรถกระบะชนได้รับความยุติธรรมแล้ว

Justice is served to a nationality-less elderly who was hit by a pickup truck (the whole story is available in the link below)

ลุงเค (นามสมมุติ) ซึ่งเป็นโจทก์ในคดีนี้ ได้ประสบอุบัติเหตุจากการถูกรถกระบะชนเมื่อวันที่ 2 ธันวาคม 2565 บนถนนเชียงใหม่-ดอยสะเก็ด ขณะกำลังขับรถจักรยานยนต์พ่วงมุ่งหน้าเข้าตัวเมืองเชียงใหม่เพื่อกลับที่พัก ทำให้โจทก์ได้รับบาดเจ็บสาหัส ขาหักบริเวณหน้าแข้งทั้งสองข้าง ข้อมือซ้ายหัก มีแผลตามใบหน้าและร่างกายหลายจุด ต้องเข้ารักษาตัวในโรงพยาบาลถึงสองครั้ง ครั้งแรกเป็นระยะเวลา 13 วัน เพื่อผ่าตัดดามกระดูก ส่วนครั้งที่สองเป็นระยะเวลา 4 วัน เพื่อผ่าตัดขาข้างซ้ายรอบที่สอง เนื่องจากกระดูกไม่เชื่อมต่อกันเองเพราะกระดูกบริเวณแข้งซ้ายดังกล่าวเสียหายอย่างรุนแรง แพทย์ผู้รักษาต้องรักษาโดยวิธีการผ่าเอากระดูกบริเวณสะโพกของโจทก์บางส่วนมาต่อเข้ากับกระดูกบริเวณแข้งซ้าย หลังจากนั้นโจทก์ต้องใช้เวลารักษาและพักฟื้นร่างกายต่อที่บ้านอีกประมาณ 5-6 เดือนถึงจะกลับมาใช้แขนซ้ายได้ และใช้เวลาประมาณ 8 เดือน ถึงจะกลับมาใช้ขาข้างขวาได้ ส่วนขาข้างซ้ายต้องใช้เวลาถึง 10 เดือน ถึงจะเริ่มเดินได้บ้าง แต่จนถึงปัจจุบันขาข้างซ้ายของโจทก์ยังไม่หายดีดังเดิม ยังต้องใช้ไม้เท้าช่วยผยุงน้ำหนักในเวลายืน หรือเดิน และยังไม่สามารถกลับไปประกอบอาชีพได้

จากการตรวจสอบพบว่า ผู้ขับขี่รถกระบะ (จำเลย) คันที่ชนโจทก์ เป็นหัวหน้าเทศกิจในหน่วยงานของรัฐแห่งหนึ่งในจังหวัดเชียงใหม่ ซึ่งทำให้ฝ่ายโจทก์เกิดข้อสงสัยว่า นี่อาจเป็นสาเหตุที่ทำให้โจทก์ไม่ได้รับความยุติธรรมตั้งแต่แรกหรือไม่ เพราะจากข้อเท็จจริงที่เกิดขึ้น โจทก์ได้รับบาดเจ็บสาหัส แต่ไม่ปรากฏหลักฐานว่าพนักงานสอบสวนเจ้าของคดีได้เดินทางไปสอบสวนโจทก์ที่โรงพยาบาล เพื่อรวบรวมพยานหลักฐานในการแจ้งข้อกล่าวหาจำเลยตามประมวลกฎหมายอาญา ฐานขับรถโดยประมาทเป็นเหตุให้ผู้อื่นได้รับอันตรายสาหัส ซึ่งมีอัตราโทษจำคุกไม่เกิน 3 ปี ปรับไม่เกิน 60,000 บาท หรือทั้งจำทั้งปรับ (โทษหนักกว่า) แต่กลับแจ้งข้อกล่าวหาจำเลยตาม พ.ร.บ. จราจรทางบก ฐานขับรถโดยประมาท หรือหวาดเสียว อันอาจเกิดอันตรายแก่บุคคล หรือทรัพย์สิน ซึ่งมีโทษปรับตั้งแต่ 400-1,000 บาท ประกอบประมวลกฎหมายอาญา ฐานเป็นเหตุให้ผู้อื่นได้รับบาดเจ็บและทรัพย์สินเสียหาย (โทษเบากว่า) ซึ่งมีอัตราโทษจำคุกไม่เกิน 1 เดือน ปรับไม่เกิน 10,000 บาท หรือทั้งจำทั้งปรับ สรุปแล้วจำเลยถูกเปรียบเทียบปรับเพียง 500 บาท ซึ่งไม่ถูกต้อง เพราะตามข้อเท็จจริงที่เกิดขึ้นและข้อกฎหมาย จำเลยต้องถูกแจ้งข้อกล่าวหา ฐานขับรถโดยประมาทเป็นเหตุให้ผู้อื่นได้รับอันตรายสาหัส ซึ่งพนังกงานสอบสวนต้องรวบรวมพยานหลักฐาน สรุปสำนวน แล้วเสนอพนักงานอัยการเพื่อยื่นฟ้องคดีต่อศาล แต่ที่ผลออกมาเป็นเช่นนี้ นักกฎหมายโดยทั่วไปเรียกกันว่า “การเป่าคดี” คือ ทำโทษหนักให้กลายเป็นโทษเบา นอกจากนี้ยังมีการกำหนดค่าเสียหายให้โจทก์เพียง 24,000 บาท ซึ่งไม่เป็นธรรม และขอจ่ายโดยวิธีผ่อนชำระ แล้วให้ตัวแทนของโจทก์ลงชื่อในบันทึกประจำวัน ในช่องผู้เสียหาย / ผู้ร้องทุกข์ เพื่อเป็นหลักฐาน ซึ่งก็ไม่ถูกต้องอีกเช่นกัน เพราะตัวแทนดังกล่าวไม่ใช่ทายาทของโจทก์ และไม่ได้รับมอบอำนาจเป็นลายลักษณ์อักษร จึงไม่มีอำนาจลงชื่อแทนโจทก์ แต่ที่เป็นเช่นนี้ อาจเป็นเพราะฝ่ายจำเลยได้วางแผนใช้บันทึกประจำวันนี้ซึ่งมีลักษณะเป็นสัญญาประนีประนอมยอมความ เพื่อเอาไว้ต่อสู้โจทก์ในภายหลัง ในกรณีที่โจทก์ประสงค์จะเรียกค่าเสียหายสูงกว่าที่กำหนดไว้ในบันทึกประจำวันฉบับดังกล่าวหรือไม่

นับแต่เกิดเหตุ จำเลยไม่เคยมาเยี่ยมโจทก์ ไม่เคยชำระค่าเสียตามที่ได้ตกลงกันไว้ และไม่เคยติดต่อขอเยียวยา หรือชดใช้ค่าเสียหายให้แก่โจทก์แต่อย่างใด เมื่อตัวแทนของโจทก์ติดต่อทวงถาม จำเลยก็บ่ายเบี่ยงเรื่อยมา จนเมื่อเดือน ตุลาคม 2566 (ก่อนคดีแพ่งหมดอายุความเพียง 2 เดือน) โจทก์ได้เข้าพบทนายความของมูลนิธิคว้าดาว เพื่อขอคำปรึกษาด้านกฎหมาย และหาแนวทางการแก้ไข หลังจากได้พูดคุยกันโดยละเอียดแล้ว ทางมูลนิธิฯ เห็นว่าโจทก์เป็นผู้สูงวัยไร้สัญชาติ ไม่มีญาติพี่น้อง ไม่ได้ประกอบอาชีพมาเป็นเวลาเกือบ 1 ปี ไม่มีเงินที่จะจัดหาทนายความ และไม่ได้รับความยุติธรรม ทางมูลนิธิฯจึงได้ตกลงให้ความช่วยเหลือด้านกฎหมายโดยให้ทนายความของมูลนิธิฯยื่นฟ้องคดีต่อศาล และให้โจทก์รับผิดชอบเฉพาะค่าธรรมเนียมศาล 1,000 บาท และค่าส่งหมายอีก 650 บาท ซึ่งคดีนี้หากโจทก์ต้องจ้างทนายความเอง ก็ต้องเสียค่าจ้างทนายไม่ต่ำกว่า 30,000 – 40,000 บาท ยังไม่รวมค่าธรรมเนียมศาลและค่าส่งหมาย
ต่อมาเมื่อวันที่ 13 พฤศจิกายน 2566 ทนายความของมูลนิธิฯ พร้อมกับโจทก์และพยาน ได้ลงไปดูพื้นที่เกิดเหตุและจัดทำแผนที่เกิดเหตุ ตลอดจนรวบรวมพยายหลักฐานที่เกี่ยวข้องทั้งหมด แล้วยื่นฟ้องคดีต่อศาลแขวงเชียงใหม่เมื่อวันที่ 30 พฤศจิกายน 2566 โดยเรียกร้องค่าเสียหายให้แก่โจทก์ดังต่อไปนี้
1) ค่าเสียหายต่อร่างกายและจิตใจ 175,000 บาท
2) ค่าบริการทางการแพทย์ที่ไม่รวมอยู่ในสิทธิการรักษา 670 บาท
3) ค่าจ้างให้ผู้อื่นไปรับและส่งที่โรงพยาบาล และค่าจ้างอื่น 20,865 บาท
4) ค่าซ่อมแซมรถจักรยานยนต์ และอื่นๆ 3,970 บาท
5) ค่าขาดประโยชน์จากการประกอบอาชีพ (ในอดีต) 86,400 บาท
6) ดอกเบี้ยก่อนฟ้อง 13,000 บาท
รวมเป็นค่าเสียหายทั้งสิ้น 299,905 บาท
รวมไปถึง
7) ค่าขาดประโยชน์จากการทำงาน (ในอนาคต) เดือนละ 7,200 บาท พร้อมดอกเบี้ยร้อยละ 5

ศาลได้นัดพิจารณาคดีวันที่ 13 กุมภาพันธ์ 2567 โดยโจทก์และจำเลยมาศาล และได้ทำการไกล่เกลี่ยกันจนทั้งสองฝ่ายสามารถตกลงกันได้ จำเลยยอมรับผิดตามฟ้อง และขอชดใช้ค่าเสียหายเป็นเงินจำนวน 150,000 บาท โดยวิธีการผ่อนชำระ ฝ่ายโจทก์ยอมตกลงด้วยโดยมีเงื่อนไขว่าหากจำเลยผิดนัดไม่ชำระค่าเสียหายตามที่ตกลงกัน ฝ่ายโจทก์ขอบังคับคดีตามจำนวนค่าเสียหายเดิมคือ 299,905 บาท พร้อมดอกเบี้ยร้อยละ 5 อีกทั้งได้สงวนสิทธิ์ในการยื่นฟ้องจำเลยในคดีอาญา ฐานขับรถประมาทเป็นเหตุให้โจทก์ได้รับบาดเจ็บสาหัส ในกรณีที่มีเหตุจำเป็น

On the occasion of 2024 Children's Day, Kwah Dao traveled to Lamphun to donate some snacks and beverages to Lamphun Special Education Center and participate in its half-day activities. There were approximately 200 participants both Thai and Karen ethnic group mostly came from Lamphun province. The activities, gifts, foods and beverages from all generous sponsors and kind teachers from LSEC managed to overcome limitations and brought joy and excitement to both the kids and their families. 🎉👨‍👩‍👧‍👦🎊

Under its Legal Assistance Program (a program that aims to provide legal knowledge and consultation) to stateless, nationality-less, and migrant students and families living in Northern Thailand, Kwah Dao begins its new year by providing legal consultation to a stateless student who is currently facing difficulties in obtaining her birth certificate and non-Thai national identification card.

Toey (non-legal name), is a 16-year-old stateless student currently studying 1st year in a vocational school in Chiang Mai. Her parents migrated from southern Shan State of Myanmar to Thailand working as non-skilled migrant laborers for over two decades. Her parents met in 2003 when both worked in a chicken firm in Chon Buri Province before moving to Bangkok. A year later, Toey’s elder brother (Toy) was born In Bangkok and successfully registered his birth with the district office. Toy obtained a birth certificate without any trouble even though none of his parents obtained any type of identity documents from Myanmar or Thai government back then. However, Toy’s parents were illegal immigrants when he was born so he has not acquired Thai nationality and won’t be eligible to apply for it unless he obtained a bachelor’s degree from a Thai educational institution.

Kwah Dao Foundation is providing special legal consultation to Mr. K (assumed name), a 58-year nationality-less elderly laborer, in filing a lawsuit against a city law enforcement officer for driving a pickup truck negligently causing serious injuries to Mr. K.

This special consultation is the operation under the Legal Assistance Program of Kwah Dao, which is administered directly by our attorney, Jarudech Pechpoom, who is one of our past scholarship recipients currently working as an executive director and volunteer attorney of our organization. The story of Mr. K brought by his employer to Kwah Dao during the 2-day Legal Training for Stateless, Nationality-less, and Migrant Students conducted on the 7th and 8th of October 2023. At that time, our attorney only learned that Mr. K was hit by a pickup truck on the Chiang Mai – Chiang Rai road while he was on the way back to his accommodation. The wrongdoer promised to compensate for the damages of 24,000 baht by the installment plan but did not once make the payment.

This legal training is the collaboration between Kwah Dao Foundation, Child’s Dream Foundation, and Shan Youth Power conducted on the 7th and 8th of October 2023 at Neau Klow Scout Camp, Lanna Human Resources Development Center.

The purpose of this training is to educate the stateless, nationality-less, and migrant students currently living in Chiang Mai about nationality law, civil registration law, immigration law, and the procedure for applying for better civil registration status in Thailand such as 1) applying for Thai citizenship for the students who were born in Thailand or acquiring Thai citizenship by naturalization for those who were not born in Thailand, 2) applying for permanent residency for the students who were not born in Thailand but currently holding the Highlander Card or Person With No Registration Status Card issued by the Department of Provincial Administration, the Ministry of Interior of Thailand, 3) solving the problem for the students who lacked civil registration document and determined as G Code students instead or applying for Person With No Registration Status Card for the students who have been living in Thailand without any identity documents, stateless students.
