The Legal Case of Somaliland Secession from Somalia
Abstract

Somaliland's quest for indepedance and self-governace stands at more than 30 years and seems a reality in the Horn of Africa region, thus the paper presents the historical background and analysis of that ongoing journey, in reference in international legal frameworks, and its domestic supreme law of the land that came into effect through public Referendum, in May 2001.

Hence, the short legal article uses academic materials as secondary and author’s personal reflection, and legal understanding on the subject matter, without further exaggration, or incongruity, but rather what set-out by the law, in respect to Somaliland’s case for secession, and the reality on the ground, that existed for than 30 years of self-governancem, while remembering such hot topic can’t be covered through few lines.

MOGADISHU, Somalia (HORN OBSERVER) — On 12 September 2026, in the central Waberi district, a Ciyaal Weero gang cornered Cabdiqani Maxamed Cumar Baakaay and struck him with machetes, wounding his eye and skull, relatives said. He died of his injuries at Hodan Hospital. He was a student at City University of Mogadishu, months from graduating. He wasn't killed by an Al-Shabaab su***de vest or a political assassin — he was killed by an ordinary street gang.

Speaking after his son's funeral at Muuse Boqor Mosque the following day, veteran journalist Maxamed Cumar Baakaay put words to what the killing meant: "Allah gave me my son, and now Allah has taken him back. I praise Him. We have survived so many historic atrocities here in Mogadishu, only for me to lose my boy to the blades of the Ciyaal Weero.” Family members say police have since detained several suspects, though authorities have not issued an official statement confirming the arrests.
