In today's edition of The Law Teacher Sierra Leone, we shall contrast section 40 and section 5 of the Constitution of Sierra Leone. According to section 5 (1-a), the constitution says sovereignty belongs to the people from which the government derives all their powers, the same Constitution again under section 40 took all the powers given to the citizens as per section 5 (1-a) and gave to the President who now becomes the supreme executive authority of the Republic of Sierra Leone. The argument here is: how would you reconcile Section 5 (1-a) to that of Section 40? Could it be argued that the sovereign powers now rest solely on the shoulder of the President who now becomes not only the sovereign head but also the supreme executive authority? Do you think Section 40 automatically redundant the powers of the citizenry of Sierra Leone and makes the President so powerful? Food for thought!
