The Romanian Society of Construction Law aims to support the construction sector by elaborating juridical opinions regarding the legislation in the field, by promoting and developing the related fields and, not least, by maintaining strong links with individuals and companies from Romania or abroad, that are active in this field.

This week Ankara hosted the second edition of the signature joint event of the Society of Construction Law Türkiye and Society of Construction Law Romania - “From Investment to Dispute Resolution: Türkiye - Romania Conference”.

Kindly supported and hosted by the Türkiye Müteahhitler Birliği / Turkish Contractors Association, the event brought together proeminent figures of international construction and arbitration community like Sercan Kulaksizogullari, Magdalena Ghioca, Serin Geambazu, Florin Niculescu, Turgut Aycan Özcan, Basar Sahin, Petru Nicolae, Giovanni Di Folco, Silviu Munteanu, PhD., Alper Sabuncuoğlu, Ekrem Kaya, Matei PURICE, Angelica Boca, Bilge Müftüoğlu and Idil Kurt Bozoglu, which generously shared their valuable experiences and insights regarding topical issues such as the opportunities and challenges of bilateral investments and the Bilateral Investments Treaty concluded between Türkiye and Romania, the particularities of joint ventures, public tenders, and public contracts under the Romanian Law, the global impact of recent conflicts upon construction contracts’ performance and their economic rebalancing, the lessons learned form the use of AI in preparing expert reports, as well as the role of Turkish interim injunctions in disputes between contractors and their subcontractors.

The engaging exchange of ideas was complemented by the distinguished opening remarks of M. Erdal Eren (Turkish Contractors Association's President), Doru Liciu (Romanian Embassy Chargé d’Affaires), Yasemin Çetinel (SCL Türkiye's President), and Razvan Rugina (SCL Romania's President).

Many thanks to our host Türkiye Müteahhitler Birliği / Turkish Contractors Association, to the representatives of the Embassy of Romania in Ankara and to Müftüoğlu Law Office for their kind support.

We are also grateful for the outstanding event organization, warm hospitality and genuine connection extended to us during our stay in Ankara by our dearest colleagues and friends at the Society of Construction Law Türkiye.

Employers which enter into a construction contract which will take several years to be completed must have a degree of freedom to modify the scope of work. The Fidic contracts offer this flexibility preserving the fair balance of risks and responsibilities between the Parties. The Fidic Engineer has a pivotal role in interpreting the Employer’s needs and in delivering the consequent instructions to the contractor. The procedures set down guarantee the equitable payment and the successful completion of the Works, with mutual satisfaction.

Speaker: Alfonso Pelosi - Fidic Certified Adjudicator, Fidic Certified Trainer and a contracts and claims specialist. He holds an MSc degree as civil hydraulic engineer, 45+ years of experience in Contracts Management and Construction of infrastructures. Alfonso is a trainer and a regular lecturer at a post-graduated master classes in Milan and Rome. Alfonso is a chartered member of the Institution of Engineers (Italy), a member of the Dispute Resolution Board Foundation (DRBF) and a member of the Society of Construction Law (SCL).

On November 5th, Razvan Rugina, Chairman of the Romanian Society of Construction Law, participated in the launch event of Society of Construction Law Serbia (SCL Serbia), where, together with the distinguished representatives of European Society of Construction Law (ESCL), Society of Construction Law France, Society of Construction Law Türkiye, and The Society of Construction Law UK, had the opportunity to address on behalf of our Society our welcome message to our Serbian colleagues.

The event was an opportunity to highlight how our Societies share not only a similar legal system and experience in construction and infrastructure projects, but also a common vision on the future development of cooperation at the regional level.

We are confident that the experiences and good practices shared on this occasion will stimulate innovation and enrich professional dialogue, fostering stronger collaboration among our members and partners.

Building on the enthusiasm generated during the event, we look forward to deepening our cooperation through future initiatives, knowledge exchanges, and the creation of a robust regional network that supports the evolution of construction law and the advancement of best practices across our jurisdictions.

We are happy and honored to announce that the Romanian Society of Construction Law together with the Society of Construction Law Türkiye will organise in Bucharest the conference entitled "Future Forward: The Romanian-Turkish Partnerships in Construction & Infrastructure Projects".

The event will take place on September 11, 2025, in Romania, at the Novotel Bucharest City Centre, aiming to address the current challenges and opportunities of the partnerships between contractors, employers, engineers and consultants of Türkiye and Romania, while providing practical solutions for some of the most common problems of public procurement, contract management and dispute resolution faced in the ongoing infrastructure projects in Romania.

The conference will be held in English and will bring together industry leaders from both countries, representatives of Romanian public authorities, as well as internationally recognized consultants, experts and lawyers, specialized in the fields of construction, infrastructure and dispute resolution. In addition to the conference, the event will offer plenty of networking opportunities for attendees during coffee breaks and lunch in the venue's foyer.

The registration fee for the conference is 350 Lei, which includes the participation at the conference sessions, coffee breaks, and lunch.

Săptămâna trecută a fost scrisă o noua pagină în istoria Asociației Române de Dreptul Construcțiilor Romanian Society of Construction Law cu ocazia evenimentului de lansare a monografiei „Riscul în contractele de antrepriză pentru lucrări de construcții”, elaborată de domnul avocat Razvan Rugina.

Evenimentul, organizat de asociația noastră în colaborare cu Facultatea de Drept ASE și cu Wolters Kluwer Romania , a reunit reputați practicieni în construcții și infrastructură, și în soluționarea revendicărilor, litigiilor și a arbitrajelor, cadre didactice din mediul universitar și studenți ai Facultății de Drept interesați de problematica actuală a contractelor standardizate FIDIC și H.G. nr. 1/2018 din România.

Pe parcursul evenimentului au luat cuvântul:

fiind evidențiate principalele teme abordate în carte, aspectele de drept comparat în materia contractului de antrepriză de lucrări de construcții și soluțiile identificate de autor cu privire la unele dintre problemele de interpretare sau executare întâlnite în acest tip de contracte.

Alocuțiunile distinșilor invitați au fost urmate de o sesiune de autografe din partea autorului, seara încheindu-se în atmosfera caldă și jovială definitorie pentru evenimentele organizate de Romanian Society of Construction Law.

În preajma sărbătorilor de iarnă, la sfârșitul anului în care am aniversat primul deceniu de activitate remarcabilă a Asociației Române de Dreptul Construcțiilor (RSCL) la nivel național, dar și internațional, în cadrul European Society of Construction Law (ESCL), gândurile noastre cele mai calde se îndreaptă cu recunoștință către membrii comunității de dreptul construcțiilor, către colegii, prietenii și colaboratorii noștri instituționali care ne-au fost alături în toată această perioadă.

Vă dorim tuturor un Crăciun minunat alături de cei dragi, și un An Nou bogat în oportunități de dezvoltare și succes!
