O ARROUQUELAS SIM tentou e continuará a tentar envolver a população neste processo.

GREEN PARK — REFERENDUM FOR THE PEOPLE
Clarification to the People of Arrouquelas
The ARROUQUELAS SIM Movement considers it essential to clarify the situation regarding the possibility of holding a local referendum on the construction of the so-called Green Park, taking into account the legal opinion requested from ANAFRE – National Association of Parishes.
From the very beginning, we have defended a very simple principle: a project of this scale, with such a significant financial impact and consequences for the future of our parish, should not move forward without the population being properly informed and heard.
And we continue to defend exactly the same position.
The Green Park represents a very significant investment in relation to the financial capacity of the Parish of Arrouquelas. This is not a small intervention. It is a project that may extend over several years, consume substantial financial resources and limit other investments and priorities of our parish in the future.
And Arrouquelas has many other needs and priorities.
Furthermore, this project is far from being consensual. There are very different opinions among the people of Arrouquelas and, indeed, one of the political parties that currently forms part of the Executive previously held a different position on this matter.
There are also important questions that cannot simply be ignored.
The chosen location is in an area vulnerable to flooding. This year alone, the site has been flooded on several occasions. Given this reality, it is entirely legitimate to question whether this is truly the appropriate location for an investment of this scale.
We also find it extremely difficult to understand how a project of such importance can be included in the budget and activity plan while doubts remain regarding the feasibility and legal approval of the project for construction at that location.
First, there should be certainty regarding the project's feasibility. Then there should be clear information about its costs. And, when dealing with an investment of this magnitude, there should be genuine consultation with the population.
The decision should not come first, with answers being sought afterwards.
For all these reasons, the position of ARROUQUELAS SIM remains clear and consistent: we oppose this project in the form in which it has been presented, and we voted against its inclusion in the Parish's management instruments.
The PS and PSD voted in favour. These political forces therefore bear the political responsibility for the decision to move forward with this investment.
That responsibility cannot simply be avoided.
AND WHAT ABOUT THE REFERENDUM?
ARROUQUELAS SIM sought a way to directly involve the people of Arrouquelas in this decision. We considered that a local referendum could be an important instrument of democratic participation, allowing the population to express its opinion directly on a project that could significantly shape the future of our parish.
A legal opinion was therefore requested from ANAFRE. Its conclusion, however, indicates that this option may not be legally viable under the current circumstances.
According to the information provided to ANAFRE, the construction of the Green Park is already expressly included in the budget and activity plan approved by the Parish Assembly, with votes in favour from the PS and PSD and votes against from ARROUQUELAS SIM.
The project has therefore ceased to be merely a political intention or a proposal under discussion. It has formally become part of the Parish's approved management instruments.
The applicable legislation excludes from the scope of local referendums, among other matters, options contained in official plans and issues or decisions involving budgetary or financial matters.
According to ANAFRE's legal opinion, even if the question were as simple as “Do you agree with the construction of the Green Park?”, it would still concern an already approved planning option and an investment involving public expenditure, budgetary resources and financial implementation.
It is also important to clarify that this is a non-binding legal opinion, but one which ARROUQUELAS SIM respects and naturally cannot ignore.
However, this opinion also raises a very important political question:
If the population should have been heard, why was it not heard before the Green Park was included in the budget and activity plan?
This is where the real issue lies.
There is a fundamental difference between listening to the population before making a decision and trying to find a way to consult the population after that decision has already been formally approved.
If there were doubts about the wishes of the people of Arrouquelas — and there clearly are — public consultation should have taken place beforehand.
Before the project was included in the budget.
Before it was approved in the activity plan.
Before politically committing the Parish to an investment of this magnitude.
THE POLITICAL RESPONSIBILITY IS CLEAR
ANAFRE's legal opinion does not take away the right of the people of Arrouquelas to have an opinion.
It does not turn a controversial project into a consensual one.
It does not answer the questions regarding costs, location, flooding, project feasibility or the real priorities of our parish.
Nor does it prevent us from continuing to demand transparency, information and political accountability.
What the opinion demonstrates is that, after the PS and PSD approved the inclusion of this project in the budget and activity plan, the possibility of holding a formal referendum may now have become legally restricted.
Those who decided to move forward must now take responsibility for that decision before the people of Arrouquelas.
ARROUQUELAS SIM has tried, and will continue to try, to involve the population in this process. We regret that the current Executive has not shown the same willingness to promote genuine public consultation before making this political and financial commitment.
We still hope that common sense, responsibility and the defence of the interests of our parish will prevail.
Because governing is not simply about having the democratic legitimacy to make decisions.
It is about listening before deciding.
It is about explaining before spending.
It is about setting priorities.
It is about taking responsibility.
And it is about respecting the people who will ultimately pay for and live with the consequences of those decisions.
ARROUQUELAS SIM will continue to stand on the same side: the side of transparency, democratic participation and the responsible defence of our parish's resources.

For a more participatory, transparent Parish, closer to its people.
