أنشئ بموجب قانون صندوق النفقة رقم (6) لسنة 2005، الصادر في 26/ ابريل 2005م الموافق 17 ربيع الأول 1426هـ، ويتبع الصندوق لرئيس مجلس الوزراء ويتمتع بالشخصية

الاعتبارية، وله موازنة مستقلة. هذا وقد تم إصدار اللائحة التنفيذية رقم (2) لسنة 2007 تاريخ 8/10/2007م، من أجل ضمان تنفيذ أحكام قانون صندوق الفلسطيني.
