🏡 REQUIREMENTS FOR TITLE TRANSFER (Registry of Deeds)
Isa ito sa pinaka-pinagkakamalang madali, pero sa totoo lang, dito madalas nadidisgrasya ang buyers dahil kulang ang documents, mali ang sequence, o hindi alam ang tamang process.
Para smooth, safe, at hindi pabalik-balik, eto ang malinaw na guide.

🔑 THE GOLDEN RULE:
Hindi ipo-process ng Registry of Deeds (RD) ang title transfer kapag may kahit isang kulang na requirement.
Kaya dito, completeness is king.

📄 BASIC REQUIREMENTS FOR TITLE TRANSFER
(For sale of property — pinaka-common scenario)

1️⃣ Notarized Deed of Sale (DOS)
• Dapat complete at tama ang details
• Dapat naka-include ang exact technical description
• Signed by BOTH buyer and seller
• Kung may representative → kailangan ng Special Power of Attorney (SPA)
Tip:
Ayaw ng RD ng erasures. Kung may mali, gumawa ng bagong kopya.

2️⃣ Original Owner’s Duplicate Copy of Title
• TCT for land
• CCT for condominium
• Dapat actual na hawak ng seller at isusurrender sa RD
Red flag:
Kapag “nasa lawyer pa” daw ang title at ayaw ipakita — stop muna ang deal.

3️⃣ Latest Tax Declaration (Land & Improvements)
• Galing sa Assessor’s Office
• Dapat updated at nakapangalan sa seller
Note:
Kung hindi declared ang bahay → may additional steps sa assessor.

4️⃣ Valid Government IDs
• 2–3 IDs of both buyer & seller
• Clear copies, with signatures
Tip:
Ask for multiple IDs to avoid signature mismatch issues later on.

5️⃣ Certificate Authorizing Registration (CAR)
Issued by BIR
Proof na nabayaran na ang:
• Capital Gains Tax (CGT) or
• Creditable Withholding Tax (CWT)
• Documentary Stamp Tax (DST)
No CAR = No Transfer.

6️⃣ Official Receipts of Tax Payments
• CGT/CWT
• DST
Attach all receipts.
Mahigpit ang RD sa verification dito.

7️⃣ Proof of Payment of Transfer Fees
From the Local Treasurer’s Office:
• Transfer Tax
• Registration Fee

8️⃣ Other BIR & LGU Documents (As Needed)
• BIR Form 1701/1702 (kung applicable)
• Sworn Declaration of No Improvement (kung bare lot)
• Zoning Certification (required sa ibang LGU)

• Land and/or improvements
• Dapat fully paid ang amilyar

💬 REAL TALK:
Most delays happen not in the Registry of Deeds.
Nangyayari ito bago pa makarating sa RD, dahil:
• May mali sa Deed of Sale
• Missing signatures
• Lost title
• Non-updated tax declaration
• Seller with ID discrepancies
• Kulang ang receipts or attachments
Ganyan kadalas nasisira ang timeline ng buyers.
