We stress the importance of upholding international humanitarian law and support the calls for an independent investigation into the events in Negros Occidental.
We also remind the government of its role in ensuring that people are free to speak, share their experiences, and stand for their communities and the environment without fear; and in addressing the root causes of these issues. This is the foundation of a just and functioning society.
PAHRA CONDEMNS KILLING OF 19 INDIVIDUALS IN NEGROS; DEMANDS INDEPENDENT PROBE INTO POSSIBLE IHL VIOLATIONS
The Philippine Alliance of Human Rights Advocates (PAHRA) condemns the killing of 19 individuals during an "alleged encounter" in Toboso, Negros Occidental. The alliance asserts that the right to life is non-negotiable and must be the primary lens in evaluating this incident.
While state forces allege that those killed were armed combatants, PAHRA reminds the government that an "allegedly armed" status is not a license for summary ex*****on. Human rights are inherent and universal; they do not disappear in conflict. The state bears the burden of proof to show that this high fatality count was not the result of a policy that disregards due process.
Under International Humanitarian Law (IHL), the principles of distinction and proportionality are legal obligations. This is reinforced by the Philippines' own Republic Act No. 9851, or the Philippine Act on Crimes Against International Humanitarian Law, Genocide, and Other Crimes Against Humanity. This law mandates that the state prosecute those who violate the rules of war, ensuring that even in internal armed conflicts, the dignity of the person is upheld.
Any operation resulting in mass fatalities without captures warrants an immediate, transparent, and independent investigation. It is critical to verify that lethal force was a last resort and that no individuals were killed while hors de combat or as civilians.
PAHRA calls on the Commission on Human Rights (CHR) to lead an independent probe to establish the truth beyond military reports. The normalization of lethal force as a response to dissent is a direct threat to the rights of every Filipino. True security can only be achieved through the upholding of justice, the strict implementation of RA 9851, and the absolute protection of the people’s fundamental rights.
