🧏‍♂️ A PRC-accredited Real Estate Salesperson who credits a sale to another licensed real estate broker while still accredited under his or her current broker may be liable for administrative violations under Republic Act No. 9646, its Implementing Rules and Regulations (IRR), and the Code of Ethics.

The conduct may constitute the following violations:

1. Violation of the requirement that a salesperson act only under one supervising broker.

🔅Under the RESA IRR, a real estate salesperson must be accredited under and act only on behalf of the licensed real estate broker who registered and supervises the salesperson.

2. Unauthorized practice under another broker.

🔅A salesperson has no authority to perform real estate service or transact on behalf of another broker unless the accreditation has been properly transferred and recognized by the Professional Regulation Commission.

3. Dishonesty or Misrepresentation.

🔅Crediting a transaction to a broker who is not the salesperson's accredited supervising broker may amount to misrepresentation regarding the salesperson's professional affiliation and the broker responsible for the transaction.

4. Breach of Professional Ethics.

🔅The Code of Ethics requires real estate practitioners to deal honestly, fairly, and in good faith with clients and fellow practitioners. Diverting sales to another broker without the knowledge or authority of the supervising broker may constitute unethical conduct.

5. Grounds for Administrative Sanctions.

🔅If proven in an administrative proceeding before the Professional Regulatory Board of Real Estate Service, the salesperson may be subject to disciplinary measures such as:

✅️Reprimand;
✅️Suspension of accreditation; or
✅️Revocation of accreditation, depending on the seriousness of the violation and the evidence presented.

Additionally, if the other licensed broker knowingly accepted or claimed the sale despite knowing that the salesperson was still accredited under another broker, that broker may also be subject to administrative liability under RESA and its Code of Ethics.
