De Lima: Supreme Court, sumobra ang pakikialam sa impeachment ni VP Sara
Inakusahan ni Mamamayang Liberal party-list Representative Leila de Lima ang Korte Suprema na 'sobra ang pakikialam' sa impeachment trial ni Vice President Sara Duterte.
Ito'y matapos bigyang direktiba ng Supreme Court ang Kongreso na magsumite ng sworn information and documents patungkol sa impeachment case laban sa Bise Presidente.
“I'm very concerned about that kasi kung makikita mo kung ano-ano yung mga hinihingi ng Supreme Court, with all due respect to the Supreme Court para bang meron silang duda na ginawa ng tama yung proseso ng House of Representatives,” ani ni De Lima.
“Parang ang impresyon ko, again with all due respect to the Supreme Court, ay nasobrahan naman yata. Pwedeng may mga magkwestyun nito, para bang it has the hallmarks of what we call judicial overreach. Hindi kaya somubra yung pakikialam ng Korte Suprema doon sa proseso ng impeachment na nanggaling sa House of Representatives,” dagdag pa niya.
Samantala, di sang-ayon si PDP Laban Legal Counsel Atty. Israelito Torreon sa mga binitawang pahayag ng Kongresista. Sa kanyang page ay mariing tinutulan ni Atty. Torreon ang akusasyon ni De Lima laban sa Supreme Court.
"With utmost due respect to Rep. Leila De Lima, it is my humble submission that the Supreme Court’s action in requiring the House of Representatives to submit information regarding the impeachment process fall squarely within its constitutional mandate—not judicial overreach," ani ni Atty. Torreon.
"Article VIII, Section 1 of the 1987 Constitution explicitly vests the Supreme Court with the power of judicial review to determine whether any branch of government, including Congress, has committed grave abuse of discretion amounting to lack or excess of jurisdiction. This principle has been consistently upheld in landmark cases like Francisco v. House of Representatives (G.R. No. 160261, Nov. 10, 2003) and Gutierrez v. House of Representatives (G.R. No. 193459, Feb. 15, 2011). Both rulings confirm that while impeachment is indeed a political process, it is not immune from judicial scrutiny when there are allegations of constitutional or procedural violations," paglalahad niya.
"Hence, the Supreme Court is not “interfering” with impeachment per se—it is simply exercising its solemn duty to ensure that constitutional processes are faithfully observed, especially in the case of Vice-President Duterte where the manner in which the impeachment complaint was filed was rushed, a blitzkrieg maneuver that disregarded procedural safeguards.
To say otherwise would be to place the impeachment power beyond the reach of checks and balances, contrary to our system of constitutional accountability," dagdag ng abogado.
