📢 IMPORTANT ANNOUNCEMENT: Waste Collection Update 🚮

Dear Homeowners,

We would like to inform you that the City Environment and Natural Resources Office (CENRO) has issued a mandate to temporarily stop garbage collection in our subdivision. 🛑 Main reason, is that The Prestige Subdivision has not yet been officially turned over to the city or the homeowners association, meaning it remains private property. 🏡Hence, the responsibility for waste collection still falls under the developer, which was clearly stated during the last meeting on February 23, 2025, at the Clubhouse.

Additionally, Barangay Cabantian has clarified that they have no jurisdiction over private properties and, therefore, cannot intervene in this matter.❌

🙏 We also apologize for the delayed notification, as this information was supposed to be disseminated by the developer.
We understand that this may cause inconvenience, and we appreciate your patience and cooperation. In the meantime, we encourage everyone to properly manage household waste 🗑️ while we coordinate with CENRO to find a solution. Further updates will be provided as soon as possible.

📢 OFFICIAL ANNOUNCEMENT FROM HOA INTERIM OFFICERS 📢
We, the Interim Officers, DO NOT RECOGNIZE the attempted unauthorized election being circulated within our community. This action violates Republic Act 9904 (Magna Carta for Homeowners and Homeowners’ Associations) and lacks legal authority.

🔹 Who is legally allowed to call for an election under RA 9904?
✅ Interim Officers
✅ DHSUD Region XI
✅ A valid petition by the majority of homeowners

❌ The developer has NO legal authority to conduct an election. Once homeowners reside in a subdivision, election matters are governed by the homeowners themselves, not the developer.

⚠️ Key Concerns About their Letter to Call for an Election:
❓ Is the election process transparent? - There is no mention of how the election committee will be formed, how candidates will be selected, or what voting process will be used.

❓ Is the petition valid?
They claimed to be supporting a petition from the majority of homeowners. But:
➡️ Was this petition validly executed?
➡️ Were the Interim Officers consulted?
➡️ Was it properly documented and submitted to the Interim Officers?

As Interim Officers, we are responsible for acknowledging legitimate homeowner requests and coordinating with DHSUD to ensure that proper procedures are followed. This is crucial to guarantee transparency and legal compliance under RA 9904.

Furthermore, Important Questions:
✔️ Have they verified how many actual homeowners are occupants?
✔️ Do they know the required percentage of homeowners needed for a valid petition?
✔️ Does the petition meet the required quorum?

🚨 We urge all homeowners to stay vigilant. Any election that is not officially sanctioned risks being illegitimate and legally questionable in accordance with the law.

🌏 In celebration of National and the signing of the 24th Anniversary of RA 9003, also known as the Ecological Solid Waste Management Act of 2000, we took pride in organizing a series of clean-up drives at our Garbage Collection Point, held consistently over the past three weeks.

This initiative was made possible under the leadership of our newly appointed Purok Leader, Dionido Relador, along with the invaluable support of The Prestige Interim Board, our dedicated homeowner volunteers, members of MOPRETODA, and Davao Joyful Homes Realty. 🙌💚

Daghan kaayong salamat to all the volunteers who wholeheartedly contributed to the success of this activity. 💪🌍

As we move forward, we encourage all homeowners to:
✅ Follow the designated disposal schedule (Every Saturday from 4AM-8AM)
✅ Practice proper waste management (Segregate your waste)

Let’s work hand-in-hand to ensure our Garbage Collectors (CENRO- Davao) can efficiently collect our waste and help maintain a zero-waste disposal system. 🌍✨
