Ang pagkilala sa identidad ay pagkilala sa pagkatao. 🏳️‍⚧️🏳️‍🌈

Ang LEGAL GENDER RECOGNITION ay ang proseso kung saan kinikilala ng batas ang gender identity ng isang tao, kabilang na rito ang pagbabago ng pangalan at gender marker sa opisyal at legal na mga dokumento.

Sa Pilipinas, walang malinaw na batas para sa gender recognition
Sa kasong 𝐒𝐢𝐥𝐯𝐞𝐫𝐢𝐨 𝐯. 𝐑𝐞𝐩𝐮𝐛𝐥𝐢𝐜, hindi pinayagan ng Korte Suprema ang pagbabago ng pangalan at gender marker ng isang transgender woman na sumailalim ng gender-affirming surgery, dahil ayon sa Korte, walang batas na nagpapahintulot sa pagbabago ng kasarian sa birth certificate base lamang sa operasyon.
Sa kasong 𝐑𝐞𝐩𝐮𝐛𝐥𝐢𝐜 𝐯. 𝐂𝐚𝐠𝐚𝐧𝐝𝐚𝐡𝐚𝐧, pinayagan naman ng Korte Suprema ang pagpapalit ng pangalan (mula Jennifer tungong Jeff) at gender marker (mula female tungong male) sa birth certificate ng isang inters*x person.

Ayon sa ginawang policy review ng United Nations Development Programme at Commission on Human Rights ukol sa Legal Gender Recognition in the Philippines, isa sa mga pangunahing suliranin ang patuloy na pagkalito sa pagitan ng s*x at gender, na nagiging dahilan ng kakulangan ng malinaw na mga polisiya para sa transgender people. Dahil dito, nananatiling limitado ang legal na proteksyon laban sa diskriminasyon. Sa kabuuan, nagreresulta ito sa isang sistemang hindi ganap na natutugunan o kinikilala ang tunay na karanasan at pangangailangan ng LGBTQIA+ Filipinos.

Kapag walang legal gender recognition, nagkakaroon ng hindi pagkakatugma sa pagitan ng ID at tunay na identidad ng isang tao. Dahil dito, nahihirapan ang ilan sa pagkuha ng trabaho, pagbiyahe, at pag-akses sa iba't ibang serbisyo. Mas nagiging lantad din sila sa harassment at diskriminasyon sa iba’t ibang espasyo. Para sa ilan, ang simpleng pagpapakilala ng sarili, gamit ang kanilang pangalan at identidad, ay nagiging isang panganib sa halip na karaniwang karanasan lamang.

Upang matugunan ang mga isyung ito, kinakailangan ang isang batas na magbibigay ng malinaw at accessible na proseso para sa legal gender recognition. Mahalaga rin ang pagpapatupad ng inclusive na anti-discrimination policies upang matiyak ang pantay na proteksyon para sa lahat. Higit sa lahat, kailangan ng sistemang simple, abot-kaya, at may malinaw na gabay upang tunay na makilala at maprotektahan ang bawat identidad.

Ngayong Pride Month, ating alalahanin na ang pagkilala sa identidad ay hindi pribilehiyo — ito ay karapatan.

Ngunit hindi natatapos sa pag-alala ang kalayaan. Ito ay ang patuloy na pakikipaglaban para sa lipunang inklusibo, mapagpalaya, at —anuman ang edad, kasarian, o estado. Ito ang diwa ng kalayaan at Pride.

Ang Pride ay laban para sa tunay na kalayaan. Ang kalayaan ang bumubuhay sa Pride. ✊🏼

𝗡𝗔𝗖𝗖 𝗲𝘅𝗽𝗮𝗻𝗱𝘀 𝗹𝗲𝗴𝗮𝗹 𝗮𝗱𝗼𝗽𝘁𝗶𝗼𝗻 𝗽𝗮𝘁𝗵𝘄𝗮𝘆𝘀, 𝗽𝘂𝘀𝗵𝗲𝘀 𝗟𝗚𝗕𝗧𝗤𝗜𝗔+ 𝗰𝗼𝗺𝗺𝘂𝗻𝗶𝘁𝘆 𝘁𝗼 𝗮𝗱𝗼𝗽𝘁 ❤️💛💙

National Authority for Child Care (NACC) Undersecretary Maria Gabriela Concepcion backed the message “Love Makes a Family” during the Adoption and Alternative Child Care Week (AACCW) press conference held on June 9, 2026, opening the agency’s annual campaign on legal adoption, alternative child care, and child protection programs.

During the press conference, Undersecretary Concepcion promoted legal adoption and alternative child care as meaningful and legitimate ways of building families.

“Love is expressed in many ways, through words, time, acts of service, gifts, and physical presence. But beyond these, choosing to go through legal adoption and foster care is also an expression of love. It is not only a legal process of building a family. It is a conscious decision to give a child safety, stability, and a permanent sense of belonging,” she said.

Under the banner “Love Makes a Family,” the NACC emphasized that children should have access to homes where they are safe, supported, and able to grow with stability.

Among the NACC advocacies, Solo Parent Adoption was highlighted as a legal option available to qualified individuals who want to adopt. This includes single persons and solo parents, including eligible members of the LGBTQIA+ community under existing law. The NACC noted that what carries weight in adoption is the ability to provide consistent care and a stable home.

Usec. Concepcion also discussed the implementation of the Simulated Birth Rectification Act (SIBRA). Since its implementation, the NACC has received 204 petitions to rectify simulated birth records. Applications may be filed until March 29, 2029.

The NACC likewise flagged the rise of online baby selling and illegal adoption schemes, reminding the public that legal adoption is now more accessible and protects children from trafficking and exploitation.

The agency also highlighted the Foundling Recognition and Protection Act and reminded the public that no child should be left in situations that place their safety and well-being at risk.

This year’s week-long celebration pushes for a broader cultural shift. The agency's message hopes to encourage the community to not limit the adoption and alternative care as secondary options. They are vital, life-giving avenues that give children what they need most: a place to belong.
