Suspension of HomeOwners Association
• Based on the 2024 Revised Implementing Rules and Regulations (IRR) of Republic Act No. 9904, all homeowners associations (HOAs) previously registered with the Securities and Exchange Commission (SEC) or the Home Insurance Guarantee Corporation (HIGC) are required to re-register with the Department of Human Settlements and Urban Development (DHSUD).
• Failure to comply with this mandate, particularly within six (6) months from the effectivity of the 2024 Revised IRR (which took effect on December 18, 2024), results in serious consequences for the association.

Automatic Suspension:
° Failure to re-register by the deadline (18 June 2025) leads to the automatic suspension of the association’s Certificate of Incorporation/Registration.

•Loss of Authority: A suspended HOA loses its authority to act as a legal entity, which includes the inability to collect dues, assessments, and fees from homeowners.

• Legal Standing: The association can no longer exercise rights and powers, such as managing common areas or enforcing association rules.

• Revocation Risk: If the association fails to file for re-registration within one (1) year from the date of suspension, its registration will be automatically revoked.
