The New Zealand Royal Commission of Inquiry into Abuse in Care recommended creating a website to help people find out how to request files and records made by organisations involved in their guardianship or care. Survivors wanted this resource to be independent of Government, so the Citizens Advice Bureau was commissioned to create the website.

This is called Kōnae: My Records Guide konae.org.nz.

Kōnae has information about more than 60 state and faith-based organisations that have records for over 800 homes and places in Aotearoa New Zealand. Those past and present places include children’s homes, hospitals, orphanages, boarding schools, Youth Justice facilities and many more.

🚗🚙🛻When buying a vehicle privately, you are not protected by the Consumer Guarantees Act or the Fair Trading Act, however there are some simple things you can do to reduce your risk when you buy privately.

👉Get a vehicle inspection
👉Check that the car has a current Warrant of Fitness
👉Check that the vehicle registration is up to date
👉Check that the Road User Charges (RUC) have been paid
👉Check that the car is not stolen or has money owing on it
👉Check if the car is subject to a safety related recall

If things go wrong after you have bought a car in a private sale, you can take a claim to the Disputes Tribunal.

📣You may be covered by the Contract and Commercial Law Act:
👉if you can prove that the seller misrepresented the vehicle and that the misrepresentation caused you loss or
👉if the seller was not the legal owner of the vehicle when they were selling it.

You can complain to the Commerce Commission if you think a business or person is not complying with one of the laws the Commerce Commission enforces. The Commerce Commission enforces the Fair Trading Act and the Commerce Act.

👉The Fair Trading Act protects consumers from misleading and deceptive trader behaviour, and unfair trading practices. The Commerce Act aims to promote competition in markets within New Zealand for the long-term benefit of consumers.

👉The Commerce Commission can’t provide you legal advice or dispute resolution in relation to your consumer problem, but it will record your complaint and if it receives similar complaints from other people about that trader the Commission can take action. It has the ability to investigate a trader’s activity and take enforcement action against them.

👉The Commerce Commission also uses the complaints it receives from the public to identify concerning business practices that are going on in the marketplace and which of these are causing the most widespread harm to people. This helps it prioritise the work it does for ensuring fair and lawful behaviour by traders and preventing harm to consumers. (Until recently the Commerce Commission used to enforce the Credit Contracts and Consumer Finance Act – the CCCFA – but the Financial Markets Authority has taken over that role).
