The Government has passed the Health and Safety at Work Amendment Act 2026.

From 1 April 2027, businesses will be required to focus on critical risks when managing their health and safety at work. Critical risks are most likely to cause death, serious injury, serious illness, or long‑term harm.

The Health and Safety at Work Amendment Bill has passed its third reading, with most changes set to come into effect on 1 April 2027. This gives businesses time to understand what's changing and prepare for the new requirements coming into force. However, one change is taking effect earlier than the rest: Approved Codes of Practice (ACOPs) can be used in court from the day after the Bill receives Royal Assent.

For construction businesses, now is a good time to:
• Review your risk register against the new critical risk threshold (severity vs. likelihood.)
• Confirm whether you're a small or large PCBU and understand what that means for your business
• Review arrangements with other PCBUs and update agreements where needed
• Make sure you keep up to date with relevant ACOPs as they are published by WorkSafe.
Getting started now will put you in a strong position when the new requirements come into effect on 1 April 2027.
