Open science was built on the notion that removing barriers to knowledge would challenge concentrations of power and allow science to serve the public good. Market logic was never in its DNA.
But openness without reciprocity, which developed countries defend to attract the private sector, can reproduce the very inequalities it was meant to challenge.
The EU, Norway, Japan, and Switzerland want rapid access to pathogen data to develop vaccines, therapeutic and diagnostics but are resisting user registration and data agreements that are essential to ensure that benefits flow back for health emergency preparedness and response.
This means that data users will have access to valuable pathogen data from developing countries through databases permitting anonymous access, without such users being held accountable by the benefits generated from use of the data.
That is not open science. That is open extraction.

Being left on read during a pandemic costs lives.
When an outbreak hits, rapid access to pathogen samples and genetic sequence data can be critical. They help researchers and companies develop the vaccines, treatments and diagnostics the world needs.
But access cannot be a one-way transaction.

Those who access pathogen resources must also have binding obligations to share the resulting benefits — vaccines, therapeutics, diagnostics, manufacturing licences, technology and know-how.

Fair and equitable benefit sharing requires that users are identifiable, access traceable and benefit-sharing enforceable. Sharing cannot be an obligation for one side and a choice for the other.

Tell the EU, Norway, Japan & Switzerland to stop demanding access while ghosting on benefit-sharing.

What we are witnessing in the PABS negotiations at the World Health Organization is fundamentally at odds with the right to science.
The right to science is not simply about a right to access scientific knowledge. It encompasses everyone's right to participate in scientific progress and to enjoy its benefits.
In the post-war debates that helped shape the right to science, there was recognition that intellectual property protections should not be permitted to create monopolies that prevent people from sharing in the benefits of scientific progress.
Nearly eighty years later, the same fundamental question is before us.
In the PABS negotiations, developing countries are being asked to provide the pathogen samples and sequence information that make scientific progress possible. Yet the European Union, Norway, Japan and Switzerland are resisting legally binding contracts at the point of access that would ensure that recipients of pathogen samples and sequences are legally bound to share benefits generated from having access to such resources.
A fair and effective PABS System must do more than facilitate access to scientific information. It must ensure that developing countries have guarantees to fair and equitable benefit sharing such as rapid access to medicines, vaccines and diagnostics, licensing for rapidly scaling up production and expanding supply options — while also enabling them to build their scientific, technological and productive capacity.
When the benefits of scientific progress are shared fairly and equitable, the right to science is truly realized. The European Union, Norway, Japan and Switzerland must stop obstructing developing countries’ right to participate in and benefit from scientific progress.
