Mazi Nnamdi Kanu Challenges Legality of His Trial — Demands Prosecution Identify Valid Law Behind Charges
Abuja, October 27, 2025

Proceedings in the case of Federal Republic of Nigeria v. Mazi Nnamdi Kanu took a decisive turn today before Justice James Omotosho of the Federal High Court, Abuja.

During the hearing, Mazi Nnamdi Kanu, who appeared in person, firmly maintained that there is no valid or subsisting charge known to law against him. Despite repeated cajoling and pressure from the judge and the prosecution team led by Chief Adegboyega Awomolo, SAN, Kanu insisted that the learned silk should read into the record or restate the law under which he is being charged and asked to enter a defence.

Chief Awomolo, SAN, was unable to identify any existing legal provision creating the offence alleged against Kanu, effectively confirming the defendant’s long-standing position that the entire proceeding lacks a legal foundation.

Justice Omotosho, in response, directed Mazi Kanu to file a written address within four (4) days on the validity of the charge and serve same on the prosecution. The Court expressly resisted all attempts by the prosecution to convert the forthcoming address into a final defence address, emphasizing that the issue before the court remains the validity of the charge itself, not the merits of any defence.

Today’s development underscores Mazi Kanu’s unyielding stance that his continued trial constitutes an unlawful process, being anchored on no known or valid law. His position remains clear: “There can be no defence where there is no valid charge.”

As soon as the court or prosecution team identify any known law that is extant and subsisting in Nigeria’s corpus juris, Mazi Nnamdi Kanu will enter his defence and witnesses he listed will be called.

In Sweet Bold Move Mazi Nnamdi Kanu Refuses To Open Defence, Says There’s No Charge Against Him

Mazi Nnamdi Kanu, leader of the Indigenous People of Biafra (IPOB), has refused to open his defence in the terrorism charge filed against him.

At the resumed proceedings on Monday, Kanu who has opted to defend himself after sacking his team of lawyers, said he has gone through his case file and there is no charge against him.

“Join me in praising God. I have gone through my case file, and there is no charge against me,” he started.

“There is no extant law in this country upon which the prosecution can predicate the charges against me. If there’s any, let my Lord read it out to me.

“So, I should not enter any defence in a charge that does not exist under any law in Nigeria. I urge you to release me today or grant me bail.”

BREAKING!!! Heavy Tight Security As Court Approves Only 10 Attendees As Nnamdi Kanu’s Trial Resumes Today

The trial of Mazi Nnamdi Kanu, leader of the Indigenous People of Biafra (IPOB), resumed today, Friday, July 18, 2025, at the Federal High Court in Abuja, with strict attendance restrictions in place.

Justice James K. Omotosho, who is presiding over the case, approved a list of only ten individuals from the side of defendant who are permitted to be present in the courtroom.

The list, obtained by our correspondent, includes eight senior lawyers and two close associates of Nnamdi Kanu. The approved legal team features several Senior Advocates of Nigeria (SANs), including Kanu G. Agabi, Dr. Onyechi Ikpeazu, Paul Erokoro, Emeka Etiaba, Mela Audu Nunghe, Dr. Joseph Akubo, Uchenna Njoku, and Aloy Ejimakor.

Also cleared to attend are Hon. Obi Aguocha, a member of the House of Representatives, and Prince Emmanuel Kanu, younger brother to the IPOB leader.

The court session, slated to begin at 9:00 a.m., follows the previous hearing where the Federal Government closed its case, and the defense was directed to file its written address on a no-case submission within 14 days.

Today’s proceedings are expected to be pivotal, as the court continues to examine whether the prosecution has established a prima facie case against the defendant.

Meanwhile, journalists and members of the public remain barred from attending the trial, a move that has continued to raise concerns over transparency and press freedom in the handling of the high-profile case.

Nnamdi Kanu has been in detention since June 2021 following his rendition from Kenya, with his trial drawing national and international attention.

QUESTION- Was Benjamin Madubugwu detained in Abuja?

ANSWER- Both Benjamin Madubugwu and Mazi Nnamdi Kanu were brought together before DSS . But Mazi Nnamdi Kanu accepted he was the one in the video and exonerated Benjamin Madubugwu

The presiding Judge angrily rejects the documents tendered by the prosecuting counsel and according to him; "This exhibits cannot be relied upon, by this court because it was obtained through illegalities, as the defendant Mazi Nnamdi was denied legal representatives before obtaining both written statement and verbal interview".

Following the rejection of previous tendered documents by the court, he presents another from NBC.

Prosecuting Counsel - Can you identify this document?
