🚨Let’s Talk About the Powers of the Nigerian Police

It’s important to understand what the law actually allows the police to do, and where your rights begin. Knowing this can help you respond properly if you ever find yourself in such a situation.

🥢Can the police arrest you without an arrest warrant?
Yes, they can. The law allows a police officer to arrest a person without a warrant in certain circumstances. This power is provided under Section 32 of the Police Act, 2020.

🥢Can the police search your house, office, or premises without a search warrant?
No, they cannot. The law protects your privacy. Except in specific situations allowed by law, the police are required to obtain a search warrant before searching your home or office. This protection is provided under Section 58 of the Police Act, 2020 and Section 37 of the Constitution of the Federal Republic of Nigeria.

🥢Can the police search your car without a search warrant?
Yes, they can. The law permits police officers to search a vehicle without first obtaining a warrant. This power is recognized under Section 49 of the Police Act, 2020.

🥢Can the police arrest you simply because you owe someone money?
No. The police are not debt collectors. A dispute over money is generally a civil matter that should be resolved in court. The courts have repeatedly condemned the use of the police to recover debts.
See McLarens v. Jennings (2003) 3 NWLR (Pt. 808) 470 and Madaki & Anor v. GTB (2022) LPELR-57419 (CA).

🥢Can the police arrest you for a crime committed by your friend or family member?
No. Criminal liability is personal. A person should not be arrested for an offence allegedly committed by another person. Where this happens, the affected person may have grounds to bring a civil action for violation of their rights.
See ACB v. Okonkwo (1997) 1 NWLR (Pt. 480) 195.

Understanding these basic principles can help you recognize when your rights are being respected and when they are not.
