RECORDING A PHONE CALL WITHOUT CONSENT

In Nigeria, the legality of recording a phone call without consent is a dicey issue that sits at the intersection of constitutional privacy rights and the rules of evidence.

It largely depends on the circumstances of the record and the mode of the usage.

Reason being that, there is a Constitutional provision for privacy as contained in the Section 37 of the Constitution of the Federal Republic of Nigeria 1999 (as amended) which protects right to freedom of privacy including telephone conversations. Secret recording violates that right.

Section 8 of the Cybercrimes Act 2015 makes it a criminal offence to unlawfully intercept or record private electronic communications without lawful authority.

Generally, recording a call you are personally part of is not treated as a criminal offence on its own, particularly if such recording is for a personal use, or for evidence in a dispute (e.g. contracts, threats, agreements).

The mode of recording does not stop a court from admitting such recordings as evidence, even if the other party didn’t consent.

Recording a phone call without consent might become an illegality if it is published without lawful justification, for blackmailing, for defamation, harassment, divulging confidential or privileged communication etc.

VOTER'S RIGHTS
RIGHT TO BE FREE FROM BRIBERY

Every voter has the right to make decisions freely and honestly, without being influenced by money, gifts, favors, or promises.

No individual, political party, or agent has the right to buy your vote or pressure you with incentives.

👉 Vote-buying can come in different forms, such as:
- Cash payments
- Food items or gifts
-Promises of jobs, contracts, or favors
Transportation or “inducements” tied to voting a certain way

👉 Accepting or offering bribes undermines democracy and can lead to the election of leaders who do not truly represent the people.
👉 Your vote should reflect your values, your needs, and your future—not temporary gain.

VOTERS RIGHTS
RIGHT TO SAFETY DURING ELECTIONS

Every voter has the right to feel safe and secure throughout the entire electoral process—before, during, and after elections.

No one should be exposed to violence, threats, harassment, or intimidation for choosing to vote or for their voting decisions.

👉 Security agencies have a duty to protect voters, electoral officials, and materials at polling units and surrounding areas.
👉 Political actors and supporters must conduct themselves peacefully and lawfully, without causing fear or disruption.
👉 Voters should be able to go to polling units, cast their votes, and return home without fear of harm.
👉 Any form of violence—physical attacks, destruction of property, or verbal threats—violates this fundamental right.

VOTERS RIGHTS
RIGHT TO SECRET BALLOT

Dear friendss, do you know that your vote is your personal decision, and it must remain private and protected at all times?

Every voter has the right to cast their vote in secrecy, without anyone seeing, questioning, or demanding to know their choice.

👉 No family member, political party agent, security officer, or authority has the right to force you to reveal who you voted for.
👉 You cannot be compelled to show your ballot paper or disclose your choice before, during, or after voting.
👉 Voting is done in a private space (voting cubicle) to ensure confidentiality and freedom of choice.
This right protects you from:
💥intimidation
💥Pressure from others
💥Vote-buying and coercion

Why it Matters
When your vote is secret, you are free to choose leaders based on your true beliefs, not fear or influence.

Let me say something that may shock you

Court is not for Truth.
Court is for Proof.

Yes read that again.

Many people enter court with confidence:
“As long as I’m saying the truth, I will win.”
That mindset has destroyed many strong cases.
Because in law, truth alone is powerless without proof.

You can be completely honest.
You can be 100% right.
You can even have people who “know what happened.”

But if you cannot present admissible evidence, the court can still rule against you and it will not be injustice. It will be law.

Here is the reality most people don’t know:
👉 Court does not listen to stories it weighs evidence
👉 Court does not reward emotions it applies rules
👉 Court does not assume it requires proof

Let me break it down

You gave someone money.
No agreement.
No transfer trail.
No messages.
Now they deny it.

You’re angry. You’re hurt. You know the truth.
But in court what exactly can you prove?

Another one

Everyone says a man is cheating.
The whole street “knows.” But you have no messages, no pictures, no credible evidence.
In court?
That “truth” is empty.

Here is the part people don’t like to hear

Court respects documentation more than narration.
Court respects evidence more than feelings.
Court respects proof more than belief.

So remember this simple line:
👉 Truth is what happened
👉 Proof is what you can show
And in court what you can show is everything.

This is why you must start living wisely:
✔️ Put agreements in writing
✔️ Keep receipts like your future depends on it
✔️ Save messages (don’t delete in anger)
✔️ Document transactions, even with friends and family

Because one day, you may need to prove today.
Many people don’t lose cases because they are wrong. They lose because they came with truth but no proof.

Now tell me honestly
If you were taken to court today, how much of your truth can you actually prove?

RIGYTS OF A LANDLORD
Right against damage to property.

Hello everyone, do tou know that a landlord has the right to protection against damage to their property and can require tenants to use the premises in a careful and responsible manner.

This means tenants are expected to maintain the property in good condition and avoid any actions that may cause unnecessary damage.

While normal wear and tear from everyday use is acceptable, any excessive or deliberate damage may make the tenant liable for repairs or replacement. In such cases, the landlord may seek compensation or make lawful deductions from any security deposit, provided this is done in line with the tenancy agreement and applicable laws.
This right helps preserve the value and condition of the property over time.

RIGHTS OF A LANDLORD
Right to Inspect the Property 🔍

A landlord has the right to inspect their property at reasonable times to ensure it is being properly maintained and used in accordance with the tenancy agreement.
This right, however, must be exercised with respect for the tenant’s privacy and quiet enjoyment of the premises.

The landlord is required to give adequate notice—usually agreed upon in the tenancy terms—before carrying out any inspection, except in emergency situations.

Regular inspections help the landlord identify necessary repairs, prevent damage, and ensure that the property remains in good condition throughout the tenancy.
