War Against Injustice -WAI Demands Immediate Withdrawal of Bogus Charges and Payment of ₦10 Million Compensation to Each of the Over 20 Innocent Citizens Unlawfully Arrested in Kano.

War Against Injustice today, submitted a letter of demands to the Honourable Attorney General and Commissioner for Justice, Kano State, urging the immediate withdrawal of all bogus charges, cessation of malicious prosecution and full redress for more than 20 innocent vehicle users unlawfully arrested for carrying another person on their motorcycle.

The letter, signed by Comr. Umar Ibrahim Umar, Executive Director of War Against Injustice, expresses deep concern over the increasing pattern of unlawful arrests, illegal confiscation of citizens’ property and prosecution under non-existent laws actions that flagrantly violate the 1999 Constitution and binding judicial authorities.

According to the report, operatives of the Hotoro Area Command of the Nigeria Police Force arrested the victims, impounded their motorcycles without lawful justification and arraigned them before the Magistrate Court, Gyadi-Gyadi, under a so-called “Kano State Motorcycle Act” and “Kano State Government Rules” for offences not defined in any written law.

War Against Injustice stressed that there is no law known as the Kano State Motorcycle Act, and that Kano State, under the Constitution, does not enact “Acts.” Only the National Assembly has the power to enact Acts of Parliament.

The organisation stated that these actions violate Section 36(12) of the 1999 Constitution, which clearly provides that no person shall be punished for an offence not defined in a written law. This long-standing constitutional safeguard was reaffirmed in several superior court decisions, particularly the well known case of Aoko v. Fagbemi, where the court held that no Nigerian citizen can be punished for an act not criminalised by law.

War Against Injustice condemned the involvement of State Counsel in prosecuting citizens under a non-existent law, describing it as unprofessional, unconstitutional and damaging to public trust in the justice system.

The organisation further noted that impounding the victims’ motorcycles amounts to punishment before conviction, which only a court of competent jurisdiction may impose. This violates their fundamental rights to personal liberty, freedom of movement and ownership of property.

In the letter, War Against Injustice called on the Honourable Attorney General to urgently take the following actions:

1. Immediate withdrawal of all charges filed under non-existent laws.

2. Unconditional release of all impounded motorcycles.

3. A public apology to the victims for the violation of their constitutional rights.

4. Payment of ₦10 million compensation to each affected citizen in line with Section 35(6) of the Constitution.

5. Disciplinary action against Police officers and State Counsel who acted in blatant disregard of the law.

War Against Injustice commended the Honourable Attorney General for his previous defence of constitutional rights particularly his courageous intervention during the unlawful arrest of Barr. Muhuyi Magaji and urged him to once again uphold justice and the rule of law in this matter.

War Against Injustice reaffirmed its unwavering commitment to defending the rights of ordinary citizens, combating impunity and ensuring that no individual, regardless of status, is subjected to unlawful arrest or malicious prosecution in Kano State.

War Against InjusticeWar Against Injustice -WAI Urges Youths to Shun Political Thuggery and Embrace Self-Development.

The Executive Director of War Against Injustice, Comr. Umar Ibrahim Umar, has called on Nigerian youths to take charge of their future by investing in education, skills and entrepreneurship rather than allowing themselves to be used as political thugs.

Comr. Umar made the call while featuring on a special programme on Radio Kano FM and AM on Monday, November 3, 2025. During the live session, he encouraged young people to explore opportunities for self-development through scholarships, businesses and innovation, stressing that many politicians only exploit youths for political gain and abandon them afterward in poverty.

He cautioned against the growing trend of youths being used to defend corrupt leaders on social media instead of holding them accountable for mismanaging public resources.

“Our youths must understand that leadership is not reserved for a few. They are qualified to be voted for in any political office. That is why War Against Injustice strongly supported the ‘Not Too Young To Run’ Bill until it became law. Unfortunately, many young people have not taken full advantage of that opportunity,” Comr. Umar said.

Comr. Umar reaffirmed War Against Injustice's commitment to promoting justice, accountability and Rule of law, adding that the organization will continue to engage stakeholders to ensure a just and inclusive society.

Press Release.

War Against Injustice Petitions Kano State House of Assembly to Repeal Criminal Defamation Laws for the Protection of Press Freedom and Freedom of Expression in Kano State.

War Against Injustice (WAI), a civic organization committed to promoting human rights, government accountability, democracy and the rule of law, today (3/11/2025) submitted a formal petition to the Kano State House of Assembly, urging the legislative body to review and repeal the criminal defamation provisions contained in the Kano State Penal Code and the Shari’a Penal Code Law (2000).

The petition, signed by the Executive Director, Comr. Umar Ibrahim Umar, calls for legislative reform to strengthen press freedom, protect civic space and align Kano State laws with Nigeria’s constitutional and international human rights obligations.

According to a recent report by the Wole Soyinka Centre for Investigative Journalism (WSCIJ), Kano State ranks among the top three states in Nigeria where press freedom faces the most suppression and restriction.

WAI expressed concern that some politicians and public officials have exploited criminal defamation provisions to silence dissenting voices and discourage open civic dialogue.

“The continued misuse of criminal defamation laws undermines democracy, erodes public trust and contradicts the fundamental right to freedom of expression guaranteed under Section 39(1) of the 1999 Constitution of the Federal Republic of Nigeria (as amended),” the letter reads.

The organization noted that several countries have already abolished criminal defamation laws in favor of civil remedies such as right of reply, apology, retraction or compensation for reputational harm.

WAI urged the Kano State House of Assembly to take the lead in modernizing defamation laws by constituting a special legislative committee to identify and repeal outdated provisions and to hold public hearings involving journalists, civil society actors, religious scholars and government representatives.

“Democracy thrives where citizens and journalists can speak truth to power without fear,” the letter said in part.

“We believe repealing these laws will enhance Kano’s democratic image, strengthen transparency and accountability, and promote a culture of open governance.”

War Against Injustice reaffirmed its commitment to collaborate with the Kano State House of Assembly, civil society organizations and the media to advance legislative reforms that protect freedom of expression and press independence in Nigeria.
