Here are the tax laws that Binance is allegedly to have broken:

1. Non-payment of Value-Added Tax (VAT):
The federal government accused Binance of failure to register with FIRS for tax purposes and contravening existing tax regulations within the country.

2. Company Income Tax:
One of the counts in the lawsuit pertains to Binance’s alleged failure to collect and remit various categories of taxes to the federation as stipulated by Section 40 of the FIRS Establishment Act 2007 as amended.

3. Failure to file tax returns:
Another count is that Binance violated Section 40 of the Act explicitly addressing the non-deduction and non-remittance of taxes, prescribing penalties and potential imprisonment for defaulting entities.

4. Complicity in aiding customers to evade taxes through its platform.

The Central Bank of Nigeria issued a circular to Bureau de Change operators, indicating that they have provided each BDC with $10,000 at an exchange rate of N1,251 per US dollar.

In the circular, each Bureau de Change is instructed to offer dollars to qualified customers at a rate that does not surpass 1.5% above the buying price.
This indicates that Bureau de Change are advised not to sell above N1,269 for each $1.

“We refer to our letter to you referenced TED/DIR/CON/GOM/001/071 in respect of the above subject wherein the CB approved a second tranche of sale of FX to eligible BDCs.

“We write to inform you of the sale of $10,000 to each BDC at the rate of N1,251/$1. The BDCs are to sell to eligible end users at a spread of NOT MORE THAN 1.5 per cent above the purchase price.”

Binance in Nigeria: From tax evasion to attempted evasion of justice

Nadeem Anjarwalla, one of the two Binance executives being held by Nigerian authorities fled from custody at the weekend, immediately after the Nigerian Government filed criminal charges of tax evasion against the embattled company.

The manner of escape of Anjarwalla, Binance’s regional manager for Africa, is reminiscent of that of former Chairman and CEO of Nissan, Carlos Ghosn from custody in Japan in 2019, while awaiting trial on corruption charges.

The timing of his reported escape, immediately following the filing of tax evasion charges, has lent credence to the validity of the Nigerian government’s allegations against the company.

This raises the question: If Binance and the executives are insisting on their innocence, and that they have nothing to hide about their operations in Nigeria, why did Anjarwalla escape from house arrest in Nigeria?

By all indications he was accorded various privileges, and relative freedom, while in the custody of the Nigerian government. His wife, in a recent article in a UK newspaper, confirmed this, saying, “they seem comfortable and looked after, for which I am grateful.”

For a company that was recently slammed with the biggest fine ever imposed by the United States Treasury, this move by a senior executive confirms what is already widely known in the industry, that Binance has a lot to hide, and will go to any lengths to undermine the Nigerian government, and to evade justice.

This is a company of which the US Secretary of the Treasury, Janet L. Yellen, said, “Binance turned a blind eye to its legal obligations in the pursuit of profit. Its willful failures allowed money to flow to terrorists, cybercriminals, and child abusers through its platform.”

Nigerian government sources insist the prosecution will not be deterred, and justice will still be done, regardless of any temporary setbacks.

Army troops, police repel deadly attack in Tsafe, killed several bandits, lost two vigilantes

Troops of the Joint Task Force Northwest Operation, Hadarin Daji, and the Nigerian police have repelled what could be described as a deadly attack in Tsafe local government in Zamfara state.

It was gathered that hundreds of the terrorists alleged to be led by Yusufa, the younger brother to Dogo Gide and Damtawaye, wielding riffles on motorcycles, invaded Tsafe Town in at about 11pm on Sunday, in an attempt to attack the School of Health Technology to abduct students.

The bandits devided themselves into three groups; one group dispatched through the bypass and headed to the school of health while the two other groups came into Tsafe Town.

Zagazola Makama gathered that the vigilant troops deployed at Forward Operating Base (FOB), Tsafe, responded swiftly in collaboration with the Community Protection Guards, engaging the bandits in a heavy gun battle to prevent them from infiltrating into the town.

The bandits were chanting “Ina Yan Askarawa” (where are the Community Protection Guards) when the troops intercepted them. In the gunfight that ensued, several bandits were killed while two members of the Community Protection Guards paid the supreme price.

The bandits also set two hilux vehicles belonging to the CPG and soldiers ablaze and took their dead corpses.

The third group of bandits were intercepted by the police on the bypass before getting to the college. The police engaged the terrorists in a heavy shooting and fired several teargas, which forced them to withdraw.

The deployment of the attack aircraft by the Nigerian Airforce forced the bandits to flee.

During their withdrawal, the bandits burst into a private home and abducted some road construction workers, before fleeing the scene.
