𝐁𝐀𝐈𝐋𝐀𝐁𝐋𝐄 & 𝐍𝐎𝐍-𝐁𝐀𝐈𝐋𝐀𝐁𝐋𝐄 𝐎𝐅𝐅𝐄𝐍𝐂𝐄𝐒: 𝐊𝐍𝐎𝐖 THE DIFFERENCE

Many people hear “bail” and assume it applies to every case…

But under the law, not all offences are treated the same.

Understanding this difference will help you avoid panic, protect your rights, and stay properly informed.

𝐖𝐇𝐀𝐓 𝐈𝐒 𝐁𝐀𝐈𝐋?
bail is the temporary release of a suspect by the Police, pending investigation or arraignment in court.

It is called “administrative bail” because it is granted by the Police without court involvement.

𝟏. 𝐁𝐀𝐈𝐋𝐀𝐁𝐋𝐄 𝐎𝐅𝐅𝐄𝐍𝐂𝐄𝐒

These are offences where a suspect can be granted bail at the Police Station.

They are generally minor or less serious offences not punishable by death or life imprisonment.

Examples include:
Simple assault
Criminal trespass
Public nuisance
Mischief (damage to property)
Theft (petty stealing)
Receiving stolen property...

Under the Law, Police have the power to grant Adminitrative bail in such cases.

Important Note: Police may detain a suspect while investigation is ongoing, but:

Detention must not exceed 24 hours where a court is within reasonable distance

The suspect must either be:
Charged to court, or

Released on bail if investigation is not yet concluded

𝟐. 𝐍𝐎𝐍-𝐁𝐀𝐈𝐋𝐀𝐁𝐋𝐄 𝐎𝐅𝐅𝐄𝐍𝐂𝐄𝐒

These are serious offences where bail cannot be granted at the Police Station.

Only a court of law has the authority to grant bail.

Examples include:
Culpable homicide
Armed robbery
R**e
Kidnapping
Treason

IMPORTANT NOTE:

Where a suspect is arrested for a non-bailable offence, the Police may detain for investigation, but such detention:

Must not exceed 24 hours (where court is within reasonable distance), except by court order

The suspect must be arraigned before a competent court within the lawful time

Further detention can only be by order of the court

𝐂𝐈𝐑𝐂𝐔𝐌𝐒𝐓𝐀𝐍𝐂𝐄𝐒 𝐅𝐎𝐑 𝐆𝐑𝐀𝐍𝐓𝐈𝐍𝐆 𝐁𝐀𝐈𝐋

Even in bailable offences, bail is not automatic.

The Police consider:

Nature and severity of the offence

Likelihood of the suspect absconding

Cooperation of the suspect in the investigation

Previous criminal record

Availability of reliable surety

Public intetest

𝐖𝐇𝐄𝐍 𝐁𝐀𝐈𝐋 𝐌𝐀𝐘 𝐁𝐄 𝐃𝐄𝐍𝐈𝐄𝐃

Bail may be refused if:
There is risk of escape

The suspect may interfere with investigation or witnesses

The offence, though bailable, is serious in circumstance

No reliable surety is provided

In such cases, the suspect may be taken to court for proper bail consideration.

REMEMBER: BAIL IS FREE AT THE POLICE STATION.

No officer has the right to demand money for bail.

If you are asked to pay for bail:

Do not encourage it

Report immediately to the Police Complaint Response Unit (PCRU)

Your voice can help promote accountability and professionalism in policing.

𝐅𝐈𝐍𝐀𝐋 𝐍𝐎𝐓𝐄

Bail is not a favour… it is a legal right where applicable.

Police also have the duty to:
1. Respect your rights
2. Follow due process
3. Avoid unlawful detention

Stay informed. Stay law-abiding. Stay safe.

Today, on World NGO Day,

Rigar Yanci International stands in solidarity with millions of organizations and advocates across the world who refuse to stay silent in the face of injustice.

This year’s theme, “Restoring Dignity Through Inclusion,” is not just a slogan it is a demand for action.

Dignity is a right, not a reward. Yet every day, people are pushed to the margins because of poverty, gender inequality, disability, conflict, displacement, and lack of access to basic services.

Exclusion strips people of opportunity, voice, and hope. We must not normalize this.

Inclusion is how dignity is restored. Inclusion is how justice becomes real. Inclusion is how humanity moves forward.

At Rigar Yanci International, we see the faces behind the statistics the silenced, the overlooked, the underserved.

Our work is driven by the belief that every person deserves protection, equal opportunity, and the freedom to live with dignity.

We will continue to speak for the voiceless, challenge harmful systems, and advocate for policies that put people first.

But real change cannot be achieved by NGOs alone.
