The Nyale Institute has called on all stakeholders including civil society to support the implementation of the High Court judgment on Post-Abortion Care.

The call was made by Godfrey Kangaude, Executive Director of Nyale Institute.

It follows the Ministry of Health and Sanitation’s compliance with a court order to amend its Standards and Guidelines on Post-Abortion Care.

The directive was issued in the case of AC, a Minor, versus the Ministry of Health and Others, in which the Court set a 180-day deadline for the Ministry to effect the changes.

Nyale Institute commended the Executive through the Ministry of Health for complying with the order. The organization said the move demonstrates how government branches can work together to respond to public needs and interests. It noted that the amendment addresses a longstanding gap affecting the physical and mental health of survivors of sexual and gender-based violence.

The Institute said attention must now shift to operationalizing the Court’s judgment to ensure survivors of sexual and gender-based violence can access safe abortion services in line with the laws of Malawi.

With support from development partners, Nyale Institute recently convened a stakeholders’ conference to reflect on the implications of the judgment beyond access to abortion for child survivors of sexual violence.

The Institute has finalized an Issues Paper examining the ruling’s scope regarding adult survivors, questions of consent for minors, potential administrative barriers to access, conscientious objection, access to justice under the Gender Equality Act, and the need for strengthened civic awareness and public education.

Nyale Institute said its efforts are aimed at ensuring Malawians realize their sexual and reproductive health rights, including access to safe abortion within the framework of existing law.
