The Draft Law on Amendments to the Minerals Law Has Been Finally Approved

On 16 October 2026, the Parliament of Mongolia finally approved the draft Law on Amendments to the Minerals Law, developed to improve the legal framework governing Mongolia’s geology and mining sectors, promote the efficient utilisation of natural resources, increase investment, and ensure the sustainable development of the sector.
The law represents an important step in legal reform aimed at accelerating geological surveys, prospecting and exploration activities, increasing mineral reserves, improving the mining investment environment, and enhancing the long-term economic benefits derived from natural resources.

As one of the key pillars of Mongolia’s economy, the mining sector requires a comprehensive policy approach that extends beyond mineral extraction. This includes identifying new geological resources, ensuring the rational and comprehensive utilisation of mineral deposits, developing mineral beneficiation and processing industries, and strengthening environmental accountability to improve the sector’s competitiveness.

Монгол Улсын геологи, уул уурхайн салбарын эрх зүйн орчныг боловсронгуй болгох, байгалийн баялгийг эдийн засгийн эргэлтэд үр ашигтай оруулах, хөрөнгө оруулалтыг нэмэгдүүлэх, салбарын тогтвортой хөгжлийг хангах зорилтын хүрээнд боловсруулсан Ашигт малтмалын тухай хуульд нэмэлт, өөрчлөлт оруулах тухай хуулийн төслийг 2026 оны 10 дугаар сарын 16-ны өдөр Монгол Улсын Их Хурлаар эцэслэн баталлаа.

Энэхүү хууль нь геологийн судалгаа, эрэл, хайгуулын ажлыг эрчимжүүлэх, ашигт малтмалын нөөцийг нэмэгдүүлэх, уул уурхайн салбарын хөрөнгө оруулалтын орчныг сайжруулах, байгалийн баялгийн үр өгөөжийг урт хугацаанд нэмэгдүүлэхэд чиглэсэн эрх зүйн шинэчлэлийн чухал алхам юм.

Монгол Улсын эдийн засгийн гол тулгуур салбарын нэг болох уул уурхайн салбарын өрсөлдөх чадварыг нэмэгдүүлэхийн тулд зөвхөн ашигт малтмал олборлоход бус, геологийн нөөцийг шинээр тогтоох, ордыг зохистой, иж бүрэн ашиглах, баяжуулах, боловсруулах үйлдвэрлэлийг хөгжүүлэх, байгаль орчны хариуцлагыг дээшлүүлэхэд чиглэсэн цогц бодлого шаардлагатай байна.

Хуулийн төсөлд зарчмын шинжтэй дараах асуудлуудыг тусгасан. Үүнд:

Нэгдүгээрт, геологийн судалгаа, эрэл, хайгуулын ажлыг эрчимжүүлж, эрдэс баялгийн нөөцийг нэмэгдүүлэх эрх зүйн орчныг сайжруулна. Ингэснээр ашигт малтмалын шинэ орд, илрэлийг нээн илрүүлэх, Монгол Улсын эрдэс баялгийн нөөцийг арвижуулах, салбарын урт хугацааны хөгжлийн суурийг бэхжүүлэх боломж бүрдэнэ.

Хоёрдугаарт, чухал ашигт малтмалын бодлогыг хэрэгжүүлэх эрх зүйн үндсийг бэхжүүлнэ. Дэлхийн зах зээлд эрэлт нь нэмэгдэж буй стратегийн ач холбогдолтой эрдэс баялгийн нөөцийг тогтоох, ашиглах, боловсруулах чиглэлээр үндэсний ашиг сонирхолд нийцсэн бодлого хэрэгжүүлэх боломжийг нэмэгдүүлнэ.

Гуравдугаарт, нэмүү өртөг шингэсэн бүтээгдэхүүн үйлдвэрлэж, эдийн засгийн өгөөжийг нэмэгдүүлэхэд чиглэнэ. Ашигт малтмалын нөөцийг иж бүрэн ашиглах, олборлолтоос боловсруулалт руу шилжих бодлогыг дэмжих нь нэмүү өртөг шингэсэн бүтээгдэхүүний үйлдвэрлэл, экспортыг нэмэгдүүлэх, ажлын байр бий болгоход чухал нөлөө үзүүлнэ.

Дөрөвдүгээрт, уул уурхайн салбараас орон нутагт хүртэх өгөөжийг нэмэгдүүлнэ. Ашигт малтмалын нөөц ашигласны төлбөрөөс Орон нутгийн хөгжлийн нэгдсэн санд хуваарилах хувь хэмжээг 2 дахин нэмэгдүүлж, нөлөөлөлд өртөж буй нутаг дэвсгэрт түлхүү хуваарилах бодлого хэрэгжүүлнэ.

Тавдугаарт, уурхайн нөхөн сэргээлт, хаалтын эрх зүйн зохицуулалтыг сайжруулна. Уурхайн нөхөн сэргээлт, хаалтын ажлын хэрэгжилт, санхүүжилтийн бүрдүүлэлтийг жил бүрийн уулын ажлын болон баяжуулалтын тайлантай уялдуулан тайлагнах тогтолцоог нэвтрүүлж, уурхайн хаалтын бэлтгэл, санхүүгийн хариуцлага, байгаль орчны нөхөн сэргээлтийн хэрэгжилтийг сайжруулах боломж бүрдэнэ.

Зургаадугаарт, зэсийн ашигт малтмалын нөөц ашигласны төлбөрийн хэмжээг олон улсын жишигт нийцүүлнэ. Ингэснээр зэсийн баяжмал үйлдвэрлэл 3.3 сая.тн хүртэл буюу 47 хүртэл хувиар, АМНАТ ногдуулалтыг 2.25 их наяд хүртэл буюу 37 хүртэл хувиар нэмэгдүүлэх боломж бүрдэнэ.

Ашигт малтмалын тухай хуульд оруулсан нэмэлт, өөрчлөлт нь эрдэс баялгийн салбарын хөгжлийг шинэ шатанд гаргах, хөрөнгө оруулалтын таатай орчныг бүрдүүлэх, байгалийн баялгийн өгөөжийг нэмэгдүүлэх, Монгол Улсын эдийн засгийн тогтвортой өсөлтийг дэмжихэд чиглэсэн чухал эрх зүйн шинэчлэл юм.

Mongolian ParliamentMN Approves Minerals Law Amendments, Introducing Key Mining Sector Reforms

Mongolia’s Parliament approved amendments to the Minerals Law and associated legislation during its plenary session on 16 October 2026, following the final reading of the proposed amendments.

A total of 11 accompanying draft laws were submitted alongside the main bill to improve regulatory frameworks across the sector, of which nine were approved.

The amendments introduce six key measures aimed at strengthening mineral exploration, supporting critical minerals development, promoting value-added processing, increasing local benefits from mining, improving mine closure and rehabilitation, and revising copper royalty rates.

𝐒𝐢𝐱 𝐊𝐞𝐲 𝐂𝐡𝐚𝐧𝐠𝐞𝐬 𝐭𝐨 𝐌𝐨𝐧𝐠𝐨𝐥𝐢𝐚’𝐬 𝐌𝐢𝐧𝐞𝐫𝐚𝐥𝐬 𝐋𝐚𝐰

1. Accelerating Geological Surveys and Mineral Exploration
The amendments aim to improve the legal framework for geological surveys, prospecting and exploration, creating opportunities to discover new mineral deposits and occurrences. The measures are intended to expand Mongolia’s mineral resource base and strengthen the foundations for the sector’s long-term development.

2. Strengthening the Legal Framework for Critical Minerals
The revised framework supports the development of policies aligned with Mongolia’s national interests for identifying, utilizing and processing critical and rare mineral resources, which are experiencing growing demand in global markets.

3. Promoting Mineral Processing and Value-Added Production
The amendments support a policy shift from extraction towards processing, encouraging more comprehensive utilization of mineral resources and increased production and exports of value-added products. The measures are also expected to create opportunities for additional employment.

4. Doubling the Share of Mineral Royalties Allocated to Local Development
The amendments provide for doubling the proportion of Mineral Resource Use Payments (MRUP), commonly referred to as mining royalties, allocated to the Local Development Consolidated Fund. They also envisage prioritizing funding for territories directly affected by mining activities, with the aim of increasing the benefits local communities receive from the sector.

5. Strengthening Mine Closure and Rehabilitation Obligations
A new reporting framework will link the implementation of mine closure and rehabilitation activities, together with the provision of associated financial resources, to annual mining operations and mineral processing reports. The measure is intended to improve mine closure planning, financial accountability and environmental rehabilitation.

6. Aligning Copper Royalty Rates with International Benchmarks
The amendments revise copper mineral royalty rates to bring them in line with international benchmarks. According to the information released on the amendments, the revised arrangements could enable:
- Copper concentrate production to increase to up to 3.3 million tonnes, representing growth of up to 47%.
- Mineral royalty assessments to increase to up to MNT 2.25 trillion, representing growth of up to 37%.

These figures are stated as potential outcomes under the revised framework.

The approved amendments mark a significant legislative development for Mongolia’s mining sector. Their implementation could influence mineral exploration investment, critical minerals development, domestic processing capacity, regional benefit-sharing arrangements, mine closure obligations and the copper royalty regime.

For mining companies and investors, the practical implications will depend on the final statutory provisions, implementation arrangements and any associated regulations. Further clarification of the revised copper royalty methodology and the mechanisms for allocating additional local development funding will be particularly relevant to industry stakeholders.

AustCham Mongolia is pleased to highlight the recent initiative of our member, GRATA International Mongolia, which successfully hosted a webinar on 9 October 2026 titled “Mining Regulations of Kazakhstan, Mongolia and Uzbekistan: Obtaining a New Exploration License, Royalty Fee and Incentives for Investors.”

The event brought together legal professionals, legal advisers, and representatives from more than 20 domestic and foreign-invested mining companies and law firms, both in person and online, to discuss the evolving legal and regulatory landscape of the mining sector across the three countries.

The webinar featured presentations by Yerbolat Yerkebulanov, Partner at GRATA International’s Kazakhstan office; Javokhir Urinov, Senior Associate at its Uzbekistan office; and Kherlenchimeg Soyolkhuu, Senior Associate at its Mongolia office. Bolormaa Volodya, Partner at GRATA International’s Mongolia office, opened the session with an introduction to the firm and its international network.

Speakers shared insights into mining legislation and regulatory frameworks in their respective jurisdictions, covering exploration licensing procedures, royalty payments, and investment incentives. The presentations were followed by an interactive discussion, allowing participants to raise questions and exchange practical experience.

A key focus of the Mongolia session was the anticipated amendments to the Minerals Law, alongside regulatory developments arising from amendments to the Law on Economic Freedom and the Investment Law. Discussions examined the potential implications of these changes for mining operations and Mongolia’s investment climate.

Through this initiative, GRATA International continues to support knowledge-sharing and informed discussion on mining regulation and investment opportunities across Central Asia and Mongolia.

AustCham Mongolia member MSM Group LLC has been supporting and collaborating with the Shambala2056 Project since 2021, contributing to efforts to combat desertification and restore the environment in Mongolia’s Gobi region.

The project focuses on establishing forests in areas affected by desertification. In Erdene soum, Dornogovi Province, MSM Group has sponsored the planting and maintenance of 486 trees, helping support long-term environmental restoration and greener landscapes.

In 2025, the planted trees contributed to the absorption and processing of 585.9 tonnes of carbon dioxide and generated 1,246.57 tonnes of biomass, supporting improvements in the region’s soil structure.

Through its continued partnership with Shambala2056, MSM Group demonstrates its commitment to environmental sustainability and the restoration of Mongolia’s natural landscapes.
