Justice for Miners Lesotho Chapter is glad to announce that our very own Film "DYING FOR GOLD" by Breath Films ( Catherine Meyburgh and Richard Pakleppa) has been awarded the BEST INTERNATIONAL FILM, after participating in the Lesotho Film Festival 2023.
The Film was presented on the 6th and 7th December 2023 in Morija and Limkokwing respectively.

Fellow Claimants, widows and dependents, Justice for Miners Forum-Lesotho Chapter is still very much active and doing exploits behind the scenes. Our mandate still stands, advocating for the rights of Basotho Ex-Miners and their dependants, while guiding them on how to lodge their compensation claims with Tshiamiso Trust.
Our offices are open Monday to Thursday 8am till 4pm and Friday from 8 till 1pm.

We are located at Cathedral area, Mofumahali oa Tlholo Premises in Maseru, next to RCC Hall.

Justice for Miners Forum-Lesotho Chapter met with the JFM Mokhotlong Coordinating Committee and discussed issues concerning claimants and compensation plan.

It transpired that claimants in Mokhotlong now have to travel long distances to find lodgement sites and unable to do BMEs due to closing down of Tshiamiso Trust Office in Mokhotlong.

Where the MBOD certificate indicates 1st degree silicosis. JFM advises claimants to elect to use the MBOD certificate and NOT choose t undergo a BME with the Tshiamiso Trust. UNLESS the miner has experienced severe deterioration of their lung function and may be on oxygen. In this case, JFM advises potential claimants to undergo a free bi-annual BME with the mine or an independent medical examination (will have a fee) which complies with the Tshiamiso Trust approved protocols before lodging a claim with Tshiamiso Trust.

Silicosis class 2
Where the MBOD certificate indicates 2nd degree silicosis. JFM advises claimants to elect to use the MBOD certificate and NOT choose to undergo a BME with the Tshiamiso Trust.
Silicosis class 3
Where the MBOD certificate indicates 1st or 2nd degree silicosis and tuberculosis (silico/TB OR Similar are both on the certificate) JFM advises claimants not to lodge a claim with the Tshiamiso Trust until the miner has an independent BME (will have a fee) which complies with the Tshiamiso Trust approved protocols.
(As this examination will not be free JFM will consider supporting the miner to pay for this examination to be done).
No class – will need a BME
Where the MBOD certificate indicates 1st degree Tuberculosis. JFM advises claimants to elect to use the MBOD certificate and NOT choose to undergo a BME with the Tshiamiso Trust. The claimant may consider getting their free bi-annual BME from the mines. This may result in a 2nd degree certification of TB or even a silicosis certification. BUT this should only be considered if there is evidence of silicosis and lung function is worse than 65%.

1st degree Tuberculosis
Where the MBOD certificate indicates 2nd degree Tuberculosis. JFM advises claimants to elect to use the MBOD certificate and NOT choose to undergo a BME with the Tshiamiso Trust. The claimant may consider having an independent BME (will have a fee) which complies with the Tshiamiso Trust approved protocols. This may result in a silicosis diagnosis. BUT this should only be considered if there is evidence of silicosis and lung function is worse than 65%.

2nd degree Tuberculosis
Where the MBOD certificate indicates 1st or 2nd degree silicosis and tuberculosis (silico/TB OR Similar are both on the certificate) JFM advises claimants not to lodge a claim with the Tshiamiso Trust until an independent BME (will have a fee) which complies with the Tshiamiso Trust approved protocols.
(As this examination will not be free JFM will consider supporting the miner to pay for this examination to be done).
No class – will need a BME

BEFORE APPLYING FOR COMPENSATION FROM THE TSHIAMISO TRUST

JFM Advises all claimants to undergo their FREE bi-annual BME (Benefit medical examination) from the mines. To claim from the MBOD for an occupational disease, BEFORE lodging a claim with the Tshiamiso Trust. If the miner is diagnosed and found to have an occupational disease, compensation will be paid by the CCOD. In the case of silicosis it will be a lump sum and the case of Tuberculosis it will be for loss of earnings while undergoing TB treatment and in some cases a lump sum.
