On behaf of Centre for Environmental Justice (CEJ) Addressing 12th Session of the United Nations Open-Ended Inter-Governmental Working Group on Transnational Corporations and Human Rights.

In his powerful address, Attorney-at-Law Ravindranath Dabare speaking on behalf of the Centre for Environmental Justice (CEJ), Friends of the Earth International, and the global campaign highlighted how environmental degradation transcends national borders and requires robust international frameworks.
Ecosystems, oceans, and biodiversity form a shared global heritage. When transnational corporations cause ecological destruction, the harm impacts not just current populations, but future generations as well.

Citing the May 2021 disaster off the western coast of Sri Lanka, Mr. Dabare pointed to the largest maritime chemical disaster in history. The vessel carrying hazardous chemicals like nitric acid, caustic soda, methanol, and 1,680 tons of plastic pellets caused severe ecological damage, disrupted fishing communities, and threatened public health.

Although Sri Lanka’s Supreme Court delivered a landmark five-bench judgment in July 2025 recognizing human rights violations and ordering the X-Press Pearl group of companies to pay an initial $1 billion in compensation, only $1 million has been reported paid to date
This vast gap between judicial orders and actual recovery underscores a critical flaw: domestic legal systems are often insufficient against powerful multinational corporations without effective international enforcement mechanisms.

Mr. Dabare urged working groups to establish a binding international treaty and a dedicated tribunal to deal with transnational corporate activities. This treaty must step in whenever national legal systems fail to protect affected communities or secure justice, ensuring that corporate accountability is never dependent solely on a country's economic power.

පරිසර යුක්ති කේන්ද්‍රය, ෆ්‍රෙන්ඩ්ස් ඔෆ් ද අර්ත් ඉන්ටර්නැෂනල් (Friends of the Earth International) සහ ගෝලීය ව්‍යාපාරය නියෝජනය කරමින් නීතිඥ රවීන්ද්‍රනාථ දබරේ මහතා විසින් සිදු කරන ලද මෙම කතාවෙන්, පාරිසරික විනාශයන් ජාතික සීමාවන් ඉක්මවා යන ආකාරය සහ ශක්තිමත් ජාත්‍යන්තර යාන්ත්‍රණවල ඇති දැඩි අවශ්‍යතාවය අවධාරණය කර ඇත.

සාගර, ජෛව විවිධත්වය සහ පරිසර පද්ධති යනු සමස්ත ලෝකයටම අයත් පොදු උරුමයකි. බහුජාතික සමාගම් විසින් සිදු කරනු ලබන පාරිසරික විනාශයන් වර්තමාන පරම්පරාවට පමණක් නොව අනාගත පරම්පරාවල අයිතිවාසිකම්වලටද බලපායි.

2021 මැයි මස ශ්‍රී ලංකාවේ බටහිර වෙරළ තීරයේදී ගිනිගෙන පසුව ගිලී ගිය, ඉතිහාසයේ විශාලතම සමුද්‍රීය රසායනික ව්‍යසනය මෙයට කදිම උදාහරණයකි. නයිට්‍රික් අම්ලය, කෝස්ටික් සෝඩා, මෙතනෝල් සහ ප්ලාස්ටික් කැට ටොන් 1,680කට අධික ප්‍රමාණයක් මුදා හැරීමෙන් සමුද්‍ර පරිසරය දැඩි ලෙස දූෂණය වූ අතර ධීවර ප්‍රජාවන්ගේ ජීවනෝපායන් බරපතළ ලෙස කඩාකප්පල් විය.

2025 ජූලි මාසයේදී ශ්‍රී ලංකාවේ ගරු ශ්‍රේෂ්ඨාධිකරණය විසින් ඓතිහාසික තීන්දුවක් ලබා දෙමින්, අදාළ සමාගම්වලට ඇමරිකානු ඩොලර් බිලියන 1කූ මුදලක් මූලික වන්දියක් ලෙස ගෙවන ලෙස නියෝග කළද, මේ වන විට ලැබී ඇත්තේ ඇමරිකානු ඩොලර් මිලියන 1ක් වැනි ඉතා සුළු මුදලකි.

අධිකරණය නියෝග කළ වන්දිය සහ ලැබී ඇති මුදම අතර ඇති මෙම දැවැන්ත පරතරය මගින් පෙනී යන්නේ, බහුජාතික සමාගම් හමුවේ දේශීය නීතිමය ක්‍රමවේද පමණක් ප්‍රමාණවත් නොවන බවයි.

ජාතික නීති පද්ධතීන්ට යුක්තිය ඉටු කිරීමට නොහැකි වන අවස්ථාවන්හිදී, බහුජාතික සමාගම්වල ක්‍රියාකාරකම් පාලනය කිරීම සඳහා ජාත්‍යන්තර විනිසුරු මණ්ඩලයක් සහ නීතිමය වශයෙන් බැඳී පවතින ගිවිසුමක් (Binding Treaty) හඳුන්වා දෙන ලෙස දබරේ මහතා අදාළ ක්‍රියාකාරී කණ්ඩායම්වලින් ඉල්ලා සිටියේය. අපගේ හවුල් පරිසරය ආරක්ෂා කිරීම සාමූහික වගකීමක් වන අතර, එය වර්තමාන හා අනාගත පරපුර වෙනුවෙන් ජාත්‍යන්තර නීතියක් බවට පත් කළ යුතුය.

🌊 National Policy Forum on Marine and Coastal Issues 2026

The National Policy Forum on Marine and Coastal Issues 2026 was successfully irganized by the CEJ on 29 September 2026 at Waters Edge, Battaramulla bringing together government representatives, academics, researchers, legal and environmental practitioners, civil society organisations, and other key stakeholders to discuss pressing issues concerning Sri Lanka’s marine and coastal environment.

The Forum featured a keynote address by Prof. Rangika Halwatura Senior Professor, Department of Civil Engineering, University of Moratuwa in: FROM SILOS TO SYSTEMS – Rethinking How We Protect Sri Lanka’s Marine and Coastal Future.”

The programme also featured presentations and discussions by Prof. Terny Pradeep Kumar, Dr. Samantha Gunasekara, and Dr. Kolitha Jinadasa, covering important areas including coastal conservation and resource management, marine environmental protection, fisheries and aquatic resource management, climate resilience, and sustainable marine and coastal futures.

The Forum provided a valuable space for dialogue among representatives from key government institutions, universities, research institutions, civil society organisations, and environmental and legal sectors.

Government participation included representatives from the Marine Environment Protection Authority (MEPA), Ministry of Environment, Department of Wildlife Conservation, Coast Conservation Department, Geological Survey and Mines Bureau, Urban Development Authority, Police Environment Protection Division, and the Marine Division of the Colombo Crime Division.

The Forum also brought together representatives from civil society organisations, including the WNPS, Earth Lanka, Blue Resources Trust, Turtle Conservation Project,and Pearl Protectors, alongside academics and researchers from leading universities across Sri Lanka.

Discussions focused on identifying policy, legal, and institutional gaps and exploring practical recommendations to strengthen the protection, conservation, and sustainable management of Sri Lanka’s marine and coastal environment.

The Forum concluded with a shared commitment to continued dialogue, collaboration, and collective action towards a more resilient and sustainable marine and coastal future for Sri Lanka.

🌍 CEJ is conducted a two-day training programme on Environmental Impact Assessment (EIA) for government officers in the Badulla District under the Swallows Project, on 24 and 25 September.

🏨 The programme was held at the Riverside Hotel, with the participation of around 25 government officers representing the CEA, RDA, Department of Wildlife Conservation, Forest Department, District and Divisional Secretariats of Rideemaliyadda, Hali-Ela, Soranathota and Meegahakiula, Department of Local Government, Irrigation Department, Urban Development Authority, and Lanka Electricity Company (Pvt) Ltd.

🎤 The overall programme is being facilitated by Mr. Ajith
Ethugala, and all participants were welcomed by Mr. Dilena Pathragoda, Executive Director of CEJ. Today’s insightful sessions were conducted by CEA Assistant Director, Dr. Nishadi Somarathana, and Dr. Samantha Suranjan.

**Highlights from the July Edition:**

⚖️ X-Press Pearl Accountability: We are continuing the legal fight for justice, seeking US$6.4 billion in compensation to address the extensive damage to marine life and coastal communities caused by Sri Lanka's worst marine environmental disaster.

🌳 Defending Kebiliththa Reserve: CEJ continues to stand firm against political pressure to release protected reserve lands for unauthorized cultivation, prompting a resurvey of the area to protect these 12,500 acres.

📱 Digital Empowerment: Rural entrepreneurs and farmer families in Rideemaliyadda received practical training in WhatsApp Business, online catalogues, and product photography to strengthen local enterprises.

🔥 Climate Action & LNG: We hosted a webinar examining the environmental impacts of Liquefied Natural Gas (LNG) expansion across South Asia and its implications for climate action.

**Highlights from the August Edition:**

🍃 Advocating for Indigenous Rights: Alongside the World Indigenous Peoples' Day gathering in Dambana, we engaged with community leaders to amplify their calls for meaningful consultation regarding laws that restrict access to their traditional lands and forest resources.

🐘 Addressing Human-Elephant Conflict (HEC): CEJ was proposed for participation in the committee for the National Action Plan on HEC, building on our ongoing legal interventions to promote long-term coexistence.

🛑 Wildlife Protection in Mahawilachchiya: To combat illegal encroachment and support responsible community action, 17 new environmental awareness billboards were installed in the Anuradhapura district.

🤝 Strengthening Local Action: We conducted monitoring and bookkeeping sessions for Nature Protection Societies in Rideemaliyadda, including groups representing persons with disabilities, to boost organizational capacity.
