Request by NSC for official assistance to Iranian vessels

President AKD urged to uphold humanitarian principle that ‘territorial sea is a boundary for exercising sovereignty and not for limiting humanitarian help’!

NSC urges President AKD to facilitate urgent official assistance to Iranian vessels stranded within Sri Lanka’s Economic Zone facing acute shortages of water, food and medicine!

Nationals of India, Bangladesh, Iran and other countries stranded with acute shortage of essentials in Iranian vessels need urgent humanitarian assistance

Iranian vessels unable to return to home ports due to blockades and threats of US sanctions require official Sri Lankan help!

In an urgent letter sent yesterday (09.10.2026) to President Anura Kumara Dissanayake, the National Shoora Council (NSC) comprising 14 national level Muslim organisations in Sri Lanka, has urged the President to uphold the humanitarian principle that the ‘territorial sea is a boundary for ‘exercising sovereignty’ and not a boundary limiting ‘humanitarian help’. NSC has urged the President that the Iranian vessels stranded South of Galle within Sri Lanka’s Exclusive Economic Zone (EEZ) are said to be facing acute shortages of water, food and medicine according to credible sources and require official government search and rescue operations and possible medical attention.

On board are civilian seafarers and workers who are nationals of Iran, India, Bangladesh and several other neighbouring countries. The Iranian civilian vessels are unable to return to the home destination owing to the continued naval blockade and the unilateral sanctions announced by Donald Trump, President of the United States, measures that carry no endorsement or authority of the United Nations or of the UN Security Council.

The NSC letter dated 09.10.2026 has been signed by NSC President M M Zuhair President’s Counsel and General Secretary Rashid M Imthiyaz Attorney at Law and copied to Minister of Foreign Affairs, Human Rights Commission of Sri Lanka, Secretary Defence and Commander of the Sri Lanka Navy.

NSC’s request to the President states, “We note with grave humanitarian concern the stated position that no supplies will be provided while these vessels remain beyond the 12-nautical-mile territorial sea. The Government has made no effort to facilitate or encourage Sri Lankan shipping agents, ship chandlers or private companies to officially deliver basic provisions. With the greatest respect, we submit that this position is not consistent with Sri Lanka’s obligations under international law, nor with the humanitarian traditions of our nation,” NSC has sought immediate official assistance to the sea farers and workers.

Obligations as a Member State of the United Nations: The UN General Assembly and the UN Human Rights Council have repeatedly expressed concern at unilateral coercive measures that obstruct basic human requirements such as access to food and medicine. Security Council Resolution 2664 (2022) itself protects humanitarian assistance even within UN sanctions regimes. Most significantly even United States sanctions practice, exempts food and medicine from the US sanctions.

Obligations under the Law of the Sea: Article 98 of the UN Convention on the Law of the Sea (UNCLOS), which applies in the EEZ through Article 58(2), requires every coastal State to maintain an adequate and effective search and rescue service. SOLAS Chapter V (Regulations 7 and 33) and the 1979 SAR Convention require assistance to persons in distress “regardless of the nationality or status of such a person or the circumstances in which that person is found”

Obligations under International Human Rights Law: As a State party to the International Covenant on Civil and Political Rights, Sri Lanka must take reasonable measures to protect the right to life (Article 6). The UN Human Rights Committee has affirmed that this duty extends to rescue at sea and to persons outside a State’s territory whose lives are directly and foreseeably affected.

Obligations under International Humanitarian Law and Neutrality: Neutrality forbids military or commercial support to a belligerent State; it never forbids feeding civilians. As the International Court of Justice held in Corfu Channel (1949), “elementary considerations of humanity” bind all States, and in Nicaragua (1986) it confirmed that strictly humanitarian aid can never be unlawful intervention. Sri Lanka is a neutral State and a party to the four Geneva Conventions of 1949. Geneva Convention II protects merchant seafarers (Article 13(5)) and encourages neutral assistance to persons at sea (Article 21).

Sri Lanka’s Own Practice: In March 2026 Sri Lanka rescued survivors of IRIS Dena in international waters and escorted IRIS Booshehr from the EEZ to harbour, which the Sri Lankan President described as a humanitarian responsibility. That conduct was accepted as correct in law and was widely welcomed. Withholding water, food and medicine from civilian seafarers today would be inconsistent with that example and with Article 27(15) of our Constitution, which directs the State to foster respect for international law and treaty obligations.

NSC’s Humble Requests:

(a) uphold the humanitarian principle that the territorial sea is a boundary for exercising sovereignty and not a boundary for limiting humanitarian assistance.

(b) withdraw the “territorial-sea” conditional limitation and declare that Sri Lanka will meet genuine humanitarian needs anywhere in its search-and-rescue region, irrespective of flag or nationality;

(c) direct MRCC Colombo, the Sri Lanka Navy and Coast Guard, with the Sri Lanka Red Cross Society and the ICRC, to assess needs and deliver drinking water, food and essential medicine as an urgent humanitarian priority, and to evacuate for immediate treatment the sick and the injured;

(d) issue clear guidance and assurance to Sri Lankan shipping agents, ship chandlers and private companies that the supply of purely humanitarian provisions is lawful and encouraged, distinct from bunkering, repairs, cargo or other commercial services;

(e) engage the Governments of Iran, India, Bangladesh and other States of nationality, and the flag States, to secure provisioning, crew welfare and repatriation; and

(f) adopt a transparent standing policy, notified through diplomatic channels, so that humanitarian relief at sea is never again held hostage to unilateral measures

Humanitarian Appeal

In the Name of Allah, the Most Gracious, the Most Merciful

His Majesty the Custodian of the Two Holy Mosques,
King Salman bin Abdulaziz Al Saud (May the Almighty Allah protect him)Royal Court, Riyadh,
Kingdom of Saudi Arabia

Assalamu Alaikum Warahmatullahi Wabarakatuhu,

Your Majesty,

Humanitarian Appeal for Consideration of Royal Clemency or Merciful Compassion in the Case of Sri Lankan Citizen Mr. Sivarasa Anujan

The National Shoora Council (NSC) of Sri Lanka is a home-grown, apolitical umbrella organization of National level Muslim organisations in Sri Lanka, established to facilitate consultation, cooperation and constructive civic engagement among Sri Lankan Muslims, while contributing towards national unity, peaceful coexistence, mutual understanding among the country’s diverse communities and raising humanitarian understanding amongst international communities.

The NSC is committed to the values of unity in diversity, religious tolerance, peaceful coexistence and respect for the constitutional rights of all citizens, within Sri Lanka’s multi-religious and multicultural national framework as well as international humanitarian laws.

It is in this spirit of humanitarian concern, mutual respect and the longstanding friendship between the peoples of Sri Lanka and the Royal Kingdom of Saudi Arabia that we have the honour, on behalf of the National Shoora Council and the people of Sri Lanka to humbly submit this urgent appeal respectfully to Your Majesty, concerning the Sri Lankan citizen, Mr. Sivarasa Anujan, who we understand has been convicted in a case concerning disrespect to the great name and reputation of Prophet Muhammad (peace and blessings of Allah be upon him), and sentenced to five years’ imprisonment together with a financial fine of three million Saudi Riyals.

We are unaware at this stage of any appeal made by or on behalf of our fellow citizen Sivarasa Anujan from the Order of the said Court to any higher Court or Forum.

At the outset, we respectfully affirm our regard for the Royal Kingdom and the people of Saudi Arabia, the country’s sovereignty, its laws and regulations, and the authority of its respected judicial institutions.

This appeal is not intended in any manner to question or contest the judgment of the competent judicial authorities. Rather, it is a humble humanitarian appeal for compassion, respectfully seeking Your Majesty’s gracious consideration of the personal and family circumstances of Mr. Sivarasa Anujan and, where permissible under the applicable laws and regulations, the exercise of royal clemency or such merciful compassionate consideration as Your Majesty may deem appropriate.

This humble appeal is based on the following humanitarian considerations:

First: Mr. Sivarasa Anujan has expressed sincere remorse for his conduct and has publicly apologized through social media, seeking forgiveness from all persons and affirming his respect for the status of the Messenger of Allah (May peace and blessings of Allah be upon him) and for the religious sentiments of Muslims. His expression of deep regret and absolute repentance is respectfully submitted as a notable circumstance worthy of compassionate consideration.

Second: It is understood that the incident arose in the context of a grave and sudden provocation and the emotional reaction to material circulated through social media concerning a sacred belief concerning the Hindu faith.

Without seeking in any manner, to legitimize or justify his conduct or interfere with the judicial findings, we wish to submit that the circumstances in which this individual had reacted, together with his subsequent conduct expressing remorse and apology, may be considered when reviewing his personal situation.

Third: Mr. Sivarasa Anujan is a modest-income Sri Lankan worker who supports a large family in Sri Lanka. His continued absence from his family has created considerable hardship for those who depend upon him. Furthermore, given his limited financial means, he is understood to have no realistic capacity to meet the substantial financial fine imposed upon him. The consequences therefore extend beyond the individual to an economically vulnerable family whose livelihood depends upon his income.

Fourth: We understand that Mr. Sivarasa Anujan had been preparing to marry a young woman from a low-income family in his village in Sri Lanka during his scheduled leave towards the end of this year. His present circumstances have consequently caused profound disappointment and uncertainty for both families and have disrupted an important family arrangement.

Fifth: Sri Lanka is a multi-religious and multicultural society, in which Buddhists, Hindus, Muslims and Christians, together with diverse ethnic, cultural and linguistic communities, live side by side. The National Shoora Council, as a civic body committed to national unity, mutual respect and peaceful coexistence, deeply values genuine harmony among all these communities.

Sixth: The case has understandably attracted attention in Sri Lanka. Compassionate consideration of Mr. Sivarasa Anujan’s circumstances would bring immense relief to his family and, we respectfully believe, would be received with deep gratitude by many Sri Lankans, while further strengthening the enduring bonds of friendship, goodwill and mutual respect between rulers of both countris and the peoples of Sri Lanka and the Kingdom of Saudi Arabia.

In the light of the foregoing, we humbly appeal to Your Majesty, renowned for wisdom, mercy and compassion, to kindly consider the mitigating circumstances of Mr. Sivarasa Anujan and, within the authority vested in Your Majesty and to the extent permitted by the applicable laws and regulations, graciously consider extending royal clemency to him, or directing such compassionate consideration of his circumstances as may lawfully be possible.

We respectfully place this sincere appeal before Your Majesty with hope in the mercy of Almighty Allah and in Your Majesty’s renowned compassion towards those facing difficult circumstances. Any gracious consideration extended to Mr. Sivarasa Anujan would bring immeasurable relief to his suffering family and would be received with profound gratitude by his loved ones.

May Allah reward Your Majesty abundantly for your service to mankind and the suffering people of the world and for upholding the noble values of justice, mercy and compassion. Please accept, Your Majesty, the assurances of our highest respect.

Yours faithfully,

M M Zuhair, President’s Counsel,
President- National Shoora Council (NSC)

Rasheed M Imthiyas, Attorney at Law
General Secretary- NSC.
