Brazil has declared that homophobic hate speech is a prisonable offence! Perhaps Sri Lanka too should follow this example.

Brazil’s Supreme Federal Court has ruled that homophobic hate speech is now punishable by prison, extending legal protections that previously only covered attacks on the LGBTQ+ community as a whole.
The justices voted 9-1 in the decision, handed down this week, putting homophobic hate speech on the same legal footing as racist hate speech, which was already punishable by prison in Brazil.
Justice Edson Fachin, the lead judge on the case, said in his ruling that protecting LGBTQ+ citizens under the law was a “constitutional imperative.”
The court had already ruled in 2019 that homophobia and transphobia were crimes equivalent to racism. But that earlier decision applied only to slurs against the LGBTQ+ community as a whole, not attacks on specific individuals.
The case was brought by ABGLT, a Brazilian rights group representing le***an, gay, bisexual, tr****ti, tr*******al and intersex people, seeking to close that gap.
Under Brazilian law, hate speech is punishable by two to five years in prison, and the penalty can reportedly be doubled if the crime is committed by two or more people.
The ruling comes eight months into President Luiz Inácio Lula da Silva’s term, following years of tension over LGBTQ+ rights under former President Jair Bolsonaro, who once called himself a “proud homophobe” and said Brazilian society doesn’t like homosexuals.
Rights groups welcomed the decision. The National LGBTI+ Alliance said the ruling brings legal certainty and reinforces the principle of equality and nondiscrimination. Transgender lawmaker Erika Hilton celebrated it on social media as a victory against LGBT-phobia.
Brazil recorded 273 violent d*aths among its LGBTQ+ community in 2022, according to one advocacy count, underscoring the stakes behind the court’s decision to close the legal loophole.
