Pakistan: Responding to the authorities’ violent and sweeping crackdown on protests in Pakistan-administered Jammu and Kashmir, Amnesty International said ⬇️

Sri Lanka: Amnesty International is concerned by the continued arrests and detentions carried out under the Prevention of Terrorism Act (PTA), notwithstanding the current administration’s stated commitment to repeal the legislation, which has long been criticized for its overly broad provisions and incompatibility with international human rights law and standards.

Recent cases underscore ongoing concerns regarding the application of the PTA. Among them is the case of Sangeethan Ganeshkumar, a 24-year-old Tamil hip-hop artist, who was arrested on 2 June and has been remanded until 17 June in connection with one of his performances, which was also shared on social media platforms. Authorities claim his performance glorifies the Liberation Tigers of Tamil Eelam (LTTE), however, the PTA’s broad and vaguely defined offences do not align with that of international law standards. Sri Lankan authorities must immediately release Sangeethan Ganeshkumar unless he is promptly charged with an internationally recognisable offence in proceedings consistent with international fair trial standards.

The same week, family and lawyers have also publicly raised concerns on due process and alleged inhumane treatment in custody of former State Intelligence Service Chief, Suresh Salley, who was arrested on 25 February in connection to the Easter Sunday bombings in April 2019 that killed more than 250 people. Sri Lankan authorities have a responsibility to provide truth, justice and reparations to the victims of the horrific Easter Sunday attacks. Those suspected to be responsible must be brought to justice through strict adherence to due process and fair trial rights.

The PTA has also been invoked in cases involving alleged drug-related criminal activity, raising further questions regarding the scope and manner of its application.

As currently framed, the PTA continues to enable arbitrary and abusive practices, including by facilitating conditions conducive to torture and other forms of ill-treatment due to the absence of adequate safeguards.

Amnesty International calls on the Sri Lankan authorities to:
•Promptly investigate all allegations concerning the abuse and misuse of the PTA;
•Investigate allegations of torture and other cruel, inhuman or degrading treatment or punishment, and ensure full due process guarantees for all detainees held under the PTA, including Suresh Salley;
•Impose an immediate moratorium on the use of the PTA; and
•Repeal the PTA without delay.

அம்னஸ்டி இன்டர்நேஷனலின் சமீபத்திய ஆய்வு, இலங்கையின் தென் மாகாணத்தில் உள்ள தனியார் தேயிலைத் தோட்டங்களில் பணிபுரியும் மலையகத் தமிழ் தோட்டத் தொழிலாளர்களின் வீட்டு பாதுகாப்பின்மை (வசிப்பிட அச்சுறுத்தல்) அவர்களின் பாதிப்பை மேலும் ஆழப்படுத்துவதை வெளிப்படுத்துகிறது.

பல தொழிலாளர்கள் தங்களின் வேலைவாய்ப்புடன் நேரடியாக இணைக்கப்பட்ட வீடுகளில், தோட்டங்களிலேயே வசிக்கிறார்கள். இதனால், அவர்கள் ஊதியத்திற்காக மட்டுமல்லாமல், தங்கள் தங்குமிடத்திற்காகவும் தோட்ட உரிமையாளர்களையே சார்ந்திருக்க வேண்டிய நிலை உருவாகிறது.

வேலை இழந்தாலோ அல்லது துஷ்பிரயோகங்களுக்கு எதிராக பேசினாலோ வீடு பறிக்கப்படும் என்ற தொடர்ச்சியான அச்சத்துடன் தொழிலாளர்கள் வாழ்கிறார்கள். இந்த சார்பு நிலை, மோசமான வாழ்வும் வேலைநிலைகளையும் எதிர்க்க முடியாமல் அவர்களை சிக்குண்டவர்களாக வைத்திருக்கிறது.

இந்த துஷ்பிரயோகங்கள், தலைமுறைகளாக பாகுபாடு, நில உரிமையின்மை மற்றும் சமூக ஒதுக்கீட்டின் காரணமாக ஏற்கனவே விளிம்புநிலைக்குத் தள்ளப்பட்ட சமூகத்தை மேலும் பாதிக்கின்றன.

இலங்கை அதிகாரிகள், மலையகத் தமிழ் தொழிலாளர்கள் போதுமான வீட்டு வசதி மற்றும் பிற சமூக-பொருளாதார உரிமைகளை பயமோ அல்லது சுரண்டலோ இன்றி பெற முடியும் வகையில் உடனடி நடவடிக்கை எடுக்க வேண்டும். வீட்டு பாதுகாப்பின்மை, மலையகத் தமிழ் தேயிலைத் தொழிலாளர்களுக்கான கட்டாய உழைப்பு ஆபத்தை மேலும் தீவிரப்படுத்துகிறது. இலங்கை அரசு மலையகத் தமிழ் தேயிலைத் தொழிலாளர்களை கட்டாய உழைப்பிலிருந்து உடனடியாகப் பாதுகாக்க வேண்டும்!

කම්කරුවන්ගේ නිවාස අවශ්‍යතාව, ඔවුන්ගේ සේවා නියුක්තිය සමග සෘජුව බැඳී පවතින බැවින්, බොහෝ කම්කරුවෝ වතු මත යැපෙති. එනම්, කම්කරුවන් බොහෝවිට වැටුප් සඳහා පමණක් නොව, සිය හිසට වහලක් හිමිකර ගැනීම සඳහා ද වතු හිමියන් මත යැපෙන තත්ත්වයක් උදා වී තිබේ.

තමන්ට රැකියාව අහිමිවීම හෝ අපයෝජනය සම්බන්ධව හඬ නැගීම සම්බන්ධව නිරන්තරයෙන් තමා බියෙන් පසුවන බව කම්කරුවෝ ප්‍රකාශ කළහ. මෙම යැපුම් තත්ත්වය හේතුවෙන්, තමා උගුලකට හසු වී ඇති බවත්, දුර්වල ජීවන මට්ටම සහ රැකියා තත්ත්වයට අභියෝග කිරීමට තමාට නොහැකි බවත් ඔවුන් බොහෝ දෙනෙකුගේ මතයයි.

මෙම අපයෝජන, පරම්පරා ගණනක පටන් වෙනස්කොට සැලකීම, ඉඩම් නොමැතිකම සහ බැහැර කිරීම හරහා දැනටමත් ආන්තීකරණය වූ ප්‍රජාවකට බරපතළ බලපෑමක් සිදු වී තිබේ.

මලෛයහ ද්‍රවිඩ කම්කරුවන් හට බියෙන් හෝ සූරාකෑමට ලක් වීමෙන් තොරව ප්‍රමාණවත් නිවාස පහසුකම් සහ වෙනත් සමාජ-ආර්ථික හිමිකම් ලබාදීම සඳහා ශ්‍රී ලංකාවේ බලධාරීන් කඩිනමින් පියවර ගත යුතුය.

නිවාස අනාරක්ෂිතබව හේතුවෙන්, මලෛයහ ද්‍රවිඩ තේ කම්කරුවන් බලහත්කාරී ශ්‍රමයට ලක් වීමේ අවදානම තවදුරටත් වර්ධනය වී තිබේ. එබැවින්, මලෛයහ ද්‍රවිඩ තේ කම්කරුවන්, බලහත්කාරී ශ්‍රමයෙන් ආරක්ෂා කිරීම සඳහා ශ්‍රී ලංකා රජය දැන්ම කටයුතු කළ යුතුය!

Amnesty International’s latest research exposes how housing insecurity is deepening the vulnerability of Malaiyaha Tamil tea workers in private tea estates in Sri Lanka’s Southern Province.

Many workers live on estates where housing is directly tied to their employment. This means workers often depend on estate owners not only for wages, but also for a roof over their heads.Workers described living with the constant fear of eviction if they lose their jobs or speak out against abuse. This dependence leaves many feeling trapped and unable to challenge poor living and working conditions.

These abuses affect a community already marginalized through generations of discrimination, landlessness, and exclusion. Sri Lankan authorities must take urgent steps to ensure Malaiyaha Tamil workers can access adequate housing and other socio-economic rights without fear or exploitation.

Housing insecurity is deepening the risk of forced labour for Malaiyaha Tamil tea workers. The Government of Sri Lanka must protect Malaiyaha Tamil tea workers from forced labour now!

மலையகத் தமிழ் தேயிலைத் தோட்டத் தொழிலாளர்களுக்கு அன்றாட அடிப்படை தேவைகளைப் பூர்த்தி செய்ய முடியாத அளவிற்கு குறைந்த ஊதியமே வழங்கப்படுகிறது. உயர்ந்து வரும் பணவீக்கம் வாழ்வை மேலும் கடினமாக்குகிறது. தொழிலாளர்கள் வேலைக்காக மட்டுமல்லாமல், வீடு மற்றும் பிற அத்தியாவசிய தேவைகளுக்கும் தோட்ட உரிமையாளர்களைச் சார்ந்திருக்க வேண்டிய நிலையை விவரிக்கிறார்கள்.

அம்னஸ்டி இன்டர்நேஷனலின் சமீபத்திய ஆய்வு, இலங்கையின் தென் மாகாணத்தில் உள்ள தனியார் தேயிலைத் தோட்டங்கள் மற்றும் சிறு தேயிலை நிலங்களில் பணிபுரியும் மலையகத் தமிழ் தொழிலாளர்கள் வறுமை, கடன் மற்றும் சுரண்டலுக்குள் மேலும் ஆழமாக தள்ளப்படுவதை வெளிச்சமிடுகிறது.

இந்த பொருளாதார பாதிப்பு பல தொழிலாளர்களை கடன் சுழற்சிகளில் சிக்கவைக்கிறது. மளிகை பொருட்கள், மருத்துவச் செலவுகள் அல்லது தோட்டங்களுக்கு இடையிலான மாற்றம் போன்ற தேவைகளுக்காக பெறப்படும் கடன்கள், தொழிலாளர்களை நீண்ட காலம், தலைமுறைகள் கடந்தும், வேலைவாய்ப்பாளர்களுடன் பிணைக்கிறது. உணவு, மின்சாரம் மற்றும் நீர் போன்ற அடிப்படை தேவைகளுக்காக தெளிவில்லாத மற்றும் முறையற்ற ஊதியக் கழிவுகள் மேற்கொள்ளப்படுவதாகவும் தொழிலாளர்கள் தெரிவித்துள்ளனர்.

ශ්‍රී ලංකාවේ දකුණු පළාතේ පුද්ගලික තේ වතුවල සේවය කරන මලෛයහ ද්‍රවිඩ තේ කම්කරුවන් දිනෙන්-දින දුගීබව, ණයගැති භාවය සහ සුරාකෑම විසින් අගාධයට ඇද දමන ආකාරය, ජාත්‍යන්තර ක්ෂමා සංවිධානය මෑතකදී සිදු කළ පර්යේෂණයෙන් හෙළිකර තිබේ.

ආර්ථිකමය වශයෙන් ඔවුන් මුහුණ දී සිටින මෙම අනතුරුදායක තත්ත්වය හේතුවෙන් බොහෝ කම්කරුවෝ ණයගැතිභාවය නමැති චක්‍රයට හසු වී සිටිති. භාණ්ඩ මිලදී ගැනීම, සෞඛ්‍ය වියදම් හෝ වතු අතර හුවමාරු වීම හේතුවෙන් කම්කරුවන් හට දීර්ඝ කාලයක පටන් හාම්පුතුන්ට බැඳී සිටීමට සිදු වී තිබේ. එම බැඳීම පරම්පරා ගණනක් වුව ද විය හැකිය. ආහාර, විදුලිය සහ ජලය සඳහා යයි කියමින් සිදු කෙරෙන අපැහැදිලි සහ අත්තනෝමතික වැටුප් කප්පාදු පිළිබඳව ද කම්කරුවන් පැමිණිලිකර තිබේ.

මෙම අපයෝජන හේතුවෙන්, පරම්පරා ගණනක පටන් වෙන්කොට සැලකීම, ඉඩම් අහිමි වීම සහ බැහැර කිරීම හරහා දැනටමත් කොන් වී සිටින ප්‍රජාවකට සිදුවන බලපෑම ඉතා බරපතළ වේ.

එබැවින්, බලහත්කාරී ශ්‍රමය සහ වෙනත් අපයෝජනවලින් මලෛයහ ද්‍රවිඩ තේ කම්කරුවන් ආරක්ෂා කිරීම සඳහා ශ්‍රී ලංකා රජය දැන්ම කටයුතු කළ යුතුය!
