HRCSL Finds Detention of Two Tamil Books Violated Fundamental Rights

The Human Rights Commission of Sri Lanka (HRCSL) has found that the continued detention of two Tamil-language books by Sri Lanka Customs violated the authors' fundamental rights, including freedom of expression, equality before the law, and language rights.

The Commission recommended the release of all copies of Ippothum Inge Irandu Thesangalthaan and Elluttal Nan Yuttam Ceykiren, which had remained detained for more than six months without a formal inquiry.

The complainant, Tamil author B. Piratheepan, was represented by a legal team that included Attorney-at-Law Nadarajar Kandeepan and Dr. Viranjana Herath, Chairperson of Media Law Forum (MLF), alongside H. Thamilaval Kandeepan.

The HRCSL highlighted concerns regarding the prolonged detention of the books, the lack of a clear procedure, and the need to protect freedom of expression and linguistic rights.
Media Law Forum emphasises the importance of safeguarding freedom of expression, media freedom and cultural rights, ensuring that restrictions on publications comply with constitutional protections and established legal standards.

Strategic Lawsuits Against Public Participation (SLAPPs) are civil or criminal lawsuits, or threats of legal action, that use abusive litigation tactics to suppress public participation and critical reporting on matters of public interest.

SLAPPs can target journalists, human rights defenders, environmental defenders, whistle-blowers, academics and civil society actors, often placing significant financial and legal pressure on those involved.

The latest UN Human Rights Civic Space Brief highlights the impact of SLAPPs on freedom of expression, access to information, media freedom and civic space, and outlines recommendations to strengthen legal protections and enable the early dismissal of abusive lawsuits.

RLS South Asia Representatives Visit Media Law Forum

The Media Law Forum (MLF) welcomed representatives of the Rosa-Luxemburg-Stiftung (RLS) South Asia to the MLF office on September 24 for a discussion aimed at further strengthening the partnership between the two organisations.

The meeting included a productive exchange on ongoing and future MLF–RLS collaboration, as well as preparations for the upcoming South Asia Democracy Conference 2026, scheduled to be held from November 3 to 5 in Colombo.

MLF thanked Britta Petersen, Resident Representative of RLS South Asia, and her colleagues Vinod Koshti, Neha Naqvi, Rajiv Kumar, and Jitendra Kumar for taking the time to visit the office and engage in the discussions despite their busy schedules.
