How to Protect Your Copyright

Copyright automatically protects your original works—books, music, art, films, and software—once they are created. However, taking extra steps can strengthen your legal rights.

✅ Key Steps to Protect Your Copyright:

1️⃣ Create & Document – Keep drafts, timestamps, and proof of authorship.
2️⃣ Register Your Copyright – While automatic, formal registration adds legal strength.
3️⃣ Use Copyright Notices – Clearly mark your work with © [Your Name] [Year].
4️⃣ Use Contracts & Licenses – Define how others can use your work through agreements.
5️⃣ Monitor & Enforce – Regularly check for unauthorized use and take legal action if needed.

Your creativity is valuable—protect it!

HOW TO REGISTER YOUR BRAND IN SRI LANKA

Registering your brand in Sri Lanka involves several steps to ensure legal protection and recognition. Here's a simplified guide:

1. **Trademark Search**: Before proceeding, conduct a thorough search to ensure your brand name or logo isn't already registered by someone else. This prevents potential conflicts.

2. **Trademark Application**: Submit an application to the National Intellectual Property Office (NIPO) of Sri Lanka. Include details such as your brand name, logo, and the products or services it represents.

3. **Examination Process**: NIPO will examine your application to ensure it meets all legal requirements. This process may take several months.

4. **Publication**: If your application passes the examination, it will be published in the Official Gazette to allow for any objections from third parties. If there are no objections within the specified period, your trademark will proceed to registration.

5. **Registration**: Once the objection period passes without any issues, your trademark will be registered, and you'll receive a certificate of registration.

6. **Maintenance**: Trademarks in Sri Lanka require periodic renewal to maintain their validity. Make sure to keep track of renewal deadlines to avoid expiration.

7. **Enforcement**: With your trademark registered, you gain legal protection against unauthorized use by others. If someone infringes on your trademark rights, you can take legal action to protect your brand.

8. **Consider Professional Assistance**: While it's possible to register a trademark independently, seeking the help of a legal professional or trademark agent can streamline the process and ensure everything is done correctly.

Remember, protecting your brand through trademark registration is crucial for establishing your identity in the market and preventing others from using your brand without permission.

Can we copy anything without the authority of the owner? Yes fair use.

The ability to use a work protected by intellectual property without the owner's consent is known as fair use. The theory aids in preventing the copyright law from being applied rigidly, which would inhibit the very creativity that the law is meant to encourage.
