مشاركة رئيسة في الحوار الثاني حول قانون وحوكمة الذكاء الاصطناعي في الجنوب العالمي، الذي عقد عبر الإنترنت، في كلمة بعنوان:
الذكاء الاصطناعي على المحك: قضية الحضارة الإنسانية.
السؤال الذي نطرحه باستمرار خاطئ. نسأل: ما مدى قوة الذكاء الاصطناعي؟ اما السؤال الحقيقي ذو الثقل الدستوري فهو: أي نوع من المجتمعات نريد أن يسهم الذكاء الاصطناعي في بنائه؟
ثلاثة انتهاكات قانونية تحدث الآن على نطاق واسع:
المسؤولية المطلقة: أنظمة الذكاء الاصطناعي المتحيزة، المنتشرة على ملايين الأجهزة، أدوات خطيرة. ومن يجب أن يتحمل العبء هم صانعو البرامج والتطبيقات، لا الضحايا.
الإجراءات القانونية الواجبة: يحرم الناس من الوظائف والقروض والتأشيرات بسبب خوارزميات لا يمكنهم الاطلاع عليها أو الطعن فيها. هذه ليست كفاءة، بل ظلم بنيوي.
تضارب المصالح: الشركات التي تضع قواعد الذكاء الاصطناعي تقيّم امتثالها هي نفسها. وفي الواقع، لا تسمح أي محكمة بذلك.
وبالنسبة للجنوب العالمي، هناك مشكلة أعمق، هي الاستعمار المعرفي: أنظمة بُنيت في أماكن أخرى، ودُرّبت في أماكن أخرى، ثم فُرضت هنا كحقيقة مطلقة.
الحل ليس في إلغاء الذكاء الاصطناعي، وانما في المساءلة والشفافية والحوكمة، التي تحترم كرامة الإنسان، لا وادي السيليكون.
فليتحقق العدل.

The question we keep asking is wrong. We ask how powerful will AI become? The real question, that bears the constitutional weight is: what kind of society do we want AI to help build?
Now, three legal violations are happening, at scale:
Strict liability : biased AI systems deployed on millions are dangerous instruments. Deployers must bear the burden. Not the victims.
Due process: people are denied jobs, loans, and visas by algorithms they cannot see or appeal. That's not efficiency. That's structural injustice.
Conflict of interest : corporations writing AI rules are also grading their own compliance. No court would allow this from any other party.
And for the Global South, there's a deeper charge: cognitive colonialism due to the fact, taht systems built elsewhere, trained elsewhere, imposed here as universal truth.
The remedy isn't abolishing AI. It's accountability, transparency, and governance that answers to human dignity, and not to Silicon Valley.
Fiat justitia ruat caelum. Let justice be done.
