Honoring Dr. Klaus Töpfer: The Visionary Father of Environmental Rule of Law
On August 12, 2025, Sri Lanka’s Supreme Court delivered a landmark judgment, overturning a 2011 Court of Appeal decision on a magnetite mining project, reaffirming the Environmental Rule of Law as a cornerstone of justice. This historic ruling, which underscores the necessity of rigorous, transparent Environmental Impact Assessments (EIAs), is a testament to a vision born decades ago under the extraordinary leadership of Dr. Klaus Töpfer, the late Executive Director of the United Nations Environment Programme (UNEP). As the former Director of UNEP’s Environmental Law and Conventions Division, I am profoundly honored to celebrate Dr. Töpfer’s legacy as the true visionary and father of this transformative initiative.
Dr. Töpfer, with unparalleled foresight, recognized that environmental protection demanded more than policy—it required a robust legal framework rooted in accountability, transparency, and justice. His bold vision for the Environmental Rule of Law—a principle ensuring that environmental laws are clear, fair, and universally upheld—set a global standard. Under his leadership, UNEP became a beacon for environmental governance, and he entrusted me, alongside colleagues like D. Kaniaru, Lal Kurukulasuriya, Adel Omar Sherif, Liz Mrema, Antonio Herman Benjamin, Scott Fulton, to champion this cause. Despite immense challenges, including months of tireless advocacy to secure approval, Dr. Töpfer’s unwavering support gave us the courage to persevere.
The Sri Lankan ruling, which safeguards natural resources for current and future generations, reflects the principles Dr. Töpfer instilled: that the environment is humanity’s shared heritage, demanding equitable stewardship and ecological integrity. His conviction that economic progress must align with sustainability resonates in this decision, which prioritizes inter-generational equity over short-term gain. From South Africa’s late Chief Justice Chaskalson to Sri Lanka’s judiciary today, the Environmental Rule of Law has evolved into a fundamental pillar of global justice, a legacy Dr. Töpfer envisioned and nurtured.
This milestone is deeply personal. Dr. Töpfer’s trust in our team, particularly in me to drive this initiative, was a defining moment in my career. His leadership inspired us to push boundaries, fostering a movement that now flourishes in courtrooms worldwide. As judiciaries increasingly recognize the Environmental Rule of Law as a bedrock principle, we see the fruits of his vision—a planet where justice protects our unique, life-sustaining environment.
I urge UNEP to convene a Global Symposium of Chief Justices to celebrate 25 years of progress in the Environmental Rule of Law. Let us unite to strengthen this commitment to environmental justice, ensuring that Dr Topfer’s vision endures for generations. With pride and humility, we declare: Mission Accomplished.
