UPDATE REGARDING THE POSTPONED PEACEFUL PROCESSION ON 10% COMMUNITY SHARE OF MINERAL ROYALTIES.

Following the postponement of the peaceful procession that had been planned by mining-affected communities, representatives of the mining-affected communities and Kwale Mining Alliance have since held a consultative meeting with the Principal Secretary, State Department for Mining , PS Harry Kimtai , on the implementation of the 10% community share of mineral royalties as per the The Mining (Mineral Royalty Sharing) Regulations, 2026.

In the meeting,we presented the petition with a clear demand on the need to: Account for the historically accumulated 10% share for the community; Clear framework for public participation and community engagement and operationalisation of the Mineral Royalty Sharing Regulations.

During the meeting, the Ministry indicated that the 10% community share attributable to Kwale County is currently estimated at around KSh 0.9 Billion, subject to reconciliation of the figures between the National Treasury and the Ministry of Mining. The exact amount will therefore be confirmed upon completion of this process.

The Ministry further indicated that the funds are held at the National Treasury and explained that the necessary budgetary and approval processes will be undertaken towards their eventual disbursement.
Importantly, the Ministry committed to move forward with the structures required to operationalise the community royalty framework. This includes the establishment of the Community Mineral Royalty Management Committees (CMRMCs), issuance of public notices to facilitate the election of community representatives, and establishment of the relevant royalty and community accounts, including the account for the Base Titanium beneficiary community.

The proceedings and commitments made during the meeting are expected to be formally captured in the official minutes of the meeting, which the Ministry has undertaken to share.

We welcome these developments as an important step forward. We also recognise that the journey is not complete and our focus now shifts from commitment to implementation.

We look forward to the confirmation of the exact royalty amount, publication of the necessary notices, establishment of the community structures and accounts, clear implementation timelines, and ultimately the release of the funds for the benefit of the rightful communities.

Kwale Mining Alliance appreciates the mining-affected communities for their unity, patience and peaceful mobilisation, and the Ministry of Mining, Blue Economy and Maritime Affairs for choosing dialogue and engagement.

Our collective responsibility as the people of Kwale now is to ensure that the commitments translate into action.

PUBLIC NOTICE: POSTPONEMENT OF PEACEFUL PROCESSION.

The organisers wish to inform mining-affected communities and members of the public that the peaceful procession scheduled for Thursday, 10th September 2026 has been POSTPONED.

This follows an invitation for representatives of the mining-affected communities to engage in a negotiation meeting with the Principal Secretary, State Department for Mining, regarding the concerns raised on the 10% community share of mineral royalties and operationalisation of the Mining (Mineral Royalty Sharing) Regulations, 2026.

In the spirit of constructive dialogue and good faith, we have agreed to give this engagement an opportunity before determining the next course of action.

We appreciate everyone who had mobilised and prepared to participate in the peaceful procession. Our demands remain unchanged, and our commitment to transparency, accountability and the rights of mining-affected communities remains firm.

Further communication will be issued following the outcome of the meeting. As it is, the Procession remains POSTPONED not CANCELLED!

INVITATION TO A PEACEFUL PROTEST
10% ROYALTY SHARE — OUR RIGHT, NOT A FAVOUR!

The mining-affected communities of Kwale County are calling upon all residents, community leaders, youth, women, elders and other stakeholders to join us in a peaceful protest to demand an explanation and the immediate release of the community’s 10% share of mineral royalties following the exit of Base Titanium Limited (BTL) from mining operations.

For years, our communities have hosted mining activities and borne their social and environmental impacts. With BTL having exited the mining operations, the community’s rightful share should not remain delayed or unaccounted for.

OUR DEMANDS
1. Immediate release of the 10% community royalty share.
2. Transparency and accountability on the status of the funds.
3. A clear explanation for the delay in releasing the community’s share.
4. Meaningful involvement of mining-affected communities in decisions concerning their mineral wealth.

Wrapping up August, the Kwale Mining Alliance (KMA) convened its 3rd Quarterly Feedback Meeting to review Q3 progress and outline priorities for the next quarter.
The forum brought together the County Mining Officer from the State Department for Mining (SDM), representatives from Base Titanium (BTL), media houses, CSOs, and community members from Kinango, Lunga Lunga, Matuga, and Msambweni Sub-Counties.
Key Discussions & Resolutions:

1. Progress & Plans: Stakeholders reviewed Q3 achievements and mapped out Q4 priorities. BTL provided an update on the status of the mine closure and the decommissioning of the plant.
2. Revenue Concerns: Community members strongly raised concerns regarding the ongoing delays in the disbursement of the 10% community share of mining revenues, demanding swift action and accountability.
3. Environmental Protection: Residents raised critical concerns regarding environmental pollution linked to local mining activities.
4. Transparency: Calls were made for greater transparency and structured community engagement whenever investors seek land consent from local communities.
5. Community Demand: The Lunga Lunga and Kinango communities urged KMA to conduct vigorous sensitization and awareness forums on Land Rights, Environmental Protection, and Mining Laws to fully empower local residents.

KMA has noted these urgent concerns and remains committed to working with partners to strengthen community education, advance environmental protection, and promote accountable mining practices across Kwale.

The Kwale Mining Alliance , joined the voices of Mrima, Kinondo, Denyenye, and Kinango in a successfully conducted site visit of the Base Titanium operations.

Our primary objective was to independently assess the progress and quality of land rehabilitation across the North, South, and Central Dunes, as well as the Tailings Storage Facility (TSF).
​We appreciate the candid and constructive engagement facilitated by Eng. Mwabwagizo and Mr. Micah Muema. This visit represents a crucial step in ensuring that environmental restoration is not just a corporate target, but a measurable, long-term reality for our communities.
​The Kwale Mining Alliance remains committed to active oversight, ensuring that mining operations prioritize the restoration of our land to a state that sustains the livelihoods and future of our people.

Kwale Mining Alliance was honoured to observe the three-day public participation exercise conducted by Stonecrest Investments Limited, a mining company seeking to extract barytes in Sega Sub-Location, Lunga Lunga Sub-County.

The sensitization activities, carried out in collaboration with the State Department for Mining on July 8th, 9th and 10th, are intended to culminate in community consent for the investor to use local land for mining. However, such consent is only meaningful if accompanied by an independent Human Rights Due Diligence process. Free, Prior, and Informed Consent (FPIC) is not optional—it is a binding legal requirement under Kenya’s Mining Act (2016) and the UN Guiding Principles on Business and Human Rights.

Barytes are critical minerals that power industries ranging from oil drilling to medical imaging, radiation shielding, and advanced technologies. Yet without robust safeguards, mining risks deepening socio-economic vulnerability and excluding communities from the very benefits their land enables.

While the Alliance acknowledges the potential of mineral exploitation to drive development and improve livelihoods, we emphasize that true viability depends on securing a genuine social license to operate - not rushed approvals.

We therefore stand united in calling for transparency, accountability, and unwavering respect for human and environmental rights.

Advancing Climate Justice & Extractive Governance in Kwale ⚖️🌱

Kwale Mining Alliance was Honored to join the Environment and Land Court (ELC) 2026 Judges Conference at Swahili Beach, Kwale County.

This year’s theme, “The Green Bench: Advancing Climate Justice, Ecosystem Protection, Sustainable Extractives Management & Environmental Rule of Law in a Changing Planet,” sets a bold agenda for mining’s future.

The conference was officially opened by Chief Justice Martha K. Koome, with addresses from State Department for Mining PS Mr. Harry Kimtai and Kwale County Governor H.E. Fatuma Achani.

As a key stakeholder in Kwale’s mining landscape, our focus over the 3 days was on:
1. Mineral Justice & Equity: Balancing state, investor, and community interests for intergenerational benefit
2. Human Rights & ESG: Social license, gender, and rights in extractives
3. Legal Certainty: Clear mineral rights processes + ELC as an enabler of extractive justice
4. Sustainability: Green mining, climate compliance, and transparent benefit-sharing

We’re committed to turning these insights into practice. Together with the judiciary and policy leaders, we’re building an equitable, transparent, and sustainable extractives sector.
