2020年3月30日に高知地裁へ提訴してから6年が過ぎました。
これまで証人尋問や双方の準備書面提出が続いています。

ビキニ被ばく船員高知訴訟（損失補償訴訟）
公正な判決を求める署名

ビキニ被ばく船員高知訴訟（損失補償訴訟）は、１９５４年の米国による水爆実験が撒き散らした放射性降下物によって、命と健康を奪われた日本の漁船員とその遺族が、１９５５年１月４日に米国政府との間で米国より２００万ドルの見舞金を受諾することで水爆実験による被害について完全な解決とするという政治決着をし、これにより米国への損害賠償請求の途を閉ざした日本政府（国）に対し、憲法２９条３項に基づき損失の補償を求めている裁判です。

１９５４年３月から５月にかけて行われた６回の水爆実験により被ばくした漁船の数は、当時の政府の調査でも延べ約１，０００隻にも及びます。漁船員は操業中に放射性降下物に汚染された雨水や海水を浴びたり利用したりし、汚染された魚を食べ、外部被ばくだけでなく、体内に放射性微粒子を取り込む内部被ばくもしていたのです。命がけで獲ったマグロを放射能汚染魚として放棄され、収入が少なく、見舞金も実損の３分の１程度で、船員にはほとんどあるいは全く支給されないまま放置されました。

日本政府は被ばくした漁船員の米国への賠償請求の途を閉ざしただけでなく、捕獲されたマグロなどの放射能検査を打ち切り、その後の船員の健康調査、疫学調査も行いませんでした。若くして被ばくした漁船員たちは４０～６０歳代で白血病やがん等におかされ、命を落としたり、少ない年金の中、通院や入院をして苦しい思いをしたりしています。その上、仕事や家族を思い被ばくしたことについて沈黙を余儀なくされたり、自身が被ばくしたことで子や子孫に何か影響が出るのではないかと悩んだりして、苦しみ続けてきました。長期にわたり人の生命や生活を脅かす事件は政治決着すべきではなかったのです。

本裁判においては、長きにわたって切り捨てられ、放置されてきた多くの被ばく船員やその遺族に対する救済の途を切り拓く、歴史的な司法判断が期待されます。

つきましては、貴裁判所に対し、以下の点を強く求めます。

１. 原告らが納得する十分な実態審理を尽くしてください。
２. 水爆実験や被ばくに関する特質を踏まえ、かつ、被ばくした漁船員を切り捨てる政治決着やその後の対応を行ってきた国の問題点等を踏まえ、公正な判断を下してください。

被告の全国健康保険協会は、軍事機密を前提とする実態とかけ離れた米側資料等に基づく専門家の意見を理由に実態も調べないまま、船員保険の認定を否定しました。訴訟でも、原告側の主張に対して、根拠がないと主張しています。これに対し、今回は、被告側が、病気との因果関係に関わる厚労省研究班報告書をもとに作成した第7準備書面を提出します。

Bikini Nuclear Exposure Lawsuit – Seamen’s Insurance Eligibility Case / Kochi District Court
The defendant, the Japan Health Insurance Association, denied the plaintiffs’ eligibility for seamen’s insurance without conducting any factual investigation, citing expert opinions based on U.S. materials that are disconnected from reality and premised on military secrecy. In court, the defendant also continues to claim that the plaintiffs’ arguments lack sufficient basis.
In this hearing, the defendant will submit their 7th preparatory brief, which is based on a report by the Ministry of Health, Labour and Welfare’s research team concerning the causal relationship between illnesses and radiation exposure. The plaintiffs will submit the second collection of signatures for the petition demanding a fair judgment.

Lawsuit on Bikini Incident Seamen – Seamen’s Insurance Coverage Suit

The defendant, the Japan Health Insurance Association, rejected the recognition under the Seamen’s Insurance scheme without conducting any investigation into the actual situation, relying instead on expert opinions based on U.S. documents that are inconsistent with the reality and premised on military secrecy. In the lawsuit, the defendant claims that the plaintiffs' assertions lack a factual basis. In response, the plaintiffs will refute these claims with the support of experts.

This session, the defendant will submit the Seventh Preparatory Document, which is based on a Ministry of Health, Labour and Welfare research team report regarding the causal relationship between illnesses and radiation exposure.
