VBSA Bill 2025: An Assault on Public Universities and Academic Freedom

SIO unequivocally condemns the VBSA Bill 2025, which seeks to repeal the UGC Act (1956), AICTE Act (1987), and NCTE Act (1993) and replace them with a highly centralised and authoritarian regulatory architecture under theHigher Education Commission of India (VBSA). Released quietly on the Members of Parliament portal on 14 December 2025, this Bill is a rebranded continuation of the deeply flawed HECI Bill of 2018, the widespread criticism and stakeholder feedback on which have been completely ignored. The government’s claim of reform is hollow; what is being pushed through is a structural overhaul that weakens public universities, undermines federalism, and accelerates the commercialisation of higher education.

At the heart of this Bill lies the deliberate dismantling of public funding for higher education. By abolishing the UGC’s grant-giving function and replacing it with a regulator armed with sweeping disciplinary powers but no financial responsibility, the state is abdicating its constitutional obligation to fund education as a public good. The redirection of funding to HEFA’s loan-based model forces universities to borrow for survival and repay debt through higher fees and cost-cutting, pushing institutions into a market logic of revenue generation. This will make higher education increasingly inaccessible to students from EWS, OBC, SC, and ST communities, for whom public universities remain the primary avenue for social mobility. SIO asserts that this shift from public grants to institutional debt is a historic betrayal of India’s commitment to equitable and affordable education.

Equally dangerous is the unprecedented centralisation of power envisaged under the VBSA framework. With all key bodies, regulation, accreditation, standards, and funding, operating under the overarching authority of a single commission whose members are appointed by the Centre, academic autonomy is reduced to a farce. The Bill empowers the central government to dictate academic standards, learning outcomes, institutional classifications, and even eligibility criteria for Vice-Chancellors and faculty. The provision that the Centre’s decision shall be final in any policy dispute, coupled with the power to supersede the Commission or councils, effectively places higher education under direct political control, eroding institutional independence and democratic governance.

The exclusion of state higher education councils from the present Bill further exposes its anti-federal character. By marginalising states and concentrating authority in New Delhi, the VBSA Bill undermines the constitutional balance in education, a subject that demands cooperative federalism. The rhetoric of “light but tight” regulation masks an authoritarian design that silences dissent, homogenises knowledge, and opens the door to ideological imposition under the guise of integrating “Bharatiya knowledge.”

SIO calls upon students, teachers, and all democratic forces to reject the VBSA Bill 2025 in its entirety. Higher education cannot be reduced to a commodity, nor can universities be transformed into debt-ridden corporations under political surveillance. We demand the immediate withdrawal of this Bill, restoration and strengthening of public funding mechanisms, and a genuinely consultative, democratic process to reform higher education in the interests of social justice, academic freedom, and constitutional values.
