From Alms to Algorithms: A Call for AI-Driven Tax Administration

CAAS has represented before the Honโ€™ble Prime Minister for urgent deployment of Artificial Intelligence in tax administration.

The objective is simple but transformative: reduce human discretion at routine chokepoints, protect confidential taxpayer data, automate genuine registrations and refunds, and ensure that every adverse action is backed by recorded reasons and accountability.

When genuine taxpayers are forced to wait for registrations, refunds, cancellations, or appeal notices, the system creates space for discretion. When taxpayer data itself becomes vulnerable, trust in governance is shaken.

AI, if deployed responsibly on Indian infrastructure with independent audit, transparent logs, and human review for adverse decisions, can become the first โ€œofficerโ€ who has no hands to receive alms and no discretion to sell.

Discretion creates corruption. Automation creates accountability.

CAAS has submitted a follow-up representation to the Industries Commissionerate, Government of Gujarat, on the continuing insistence by several DIC offices on rigid one-page CA certificate formats.

The concern is simple but serious: Chartered Accountants cannot be compelled to issue certificates without scope, limitations, responsibility clauses, basis of verification and other safeguards mandated by ICAI.

A departmental format may prescribe the information required, but it cannot override the professional framework governing Chartered Accountants.

CAAS has requested a clear State-wide circular directing all DIC offices to accept ICAI-compliant certificate formats and not delay or reject applications merely because a CA has added professional safeguards.

Professional certification is not clerical endorsement.
It is governed by ICAI. It must remain compliant.

CAAS has made a fresh representation to the Chief Electrical Inspector & Collector of Electricity Duty, Government of Gujarat, after a recent query objected to a CA certificate only because it was not in the exact prescribed format.

The issue is not about eligibility conditions or departmental data.
The issue is whether a Chartered Accountant can be forced to omit ICAI-required safeguards such as:

scope of work
basis of verification
management responsibility
practitioner responsibility
limitations and restriction on use

A certificate with safeguards is not defective.
A certificate without safeguards is risky.

CAAS has requested immediate clarification that ICAI-compliant certificates must be accepted for Electricity Duty Exemption / Subsidy matters.

Government departments may demand information.
They cannot demand professional non-compliance.

CAAS has submitted a detailed representation to the Central Pollution Control Board (CPCB) regarding futuristic and non-compliant CA certificate formats being insisted upon by Pollution Control Boards.

The core issue is serious:

A Chartered Accountant may verify historical facts, books, invoices, fixed assets and records.
But a CA cannot certify that an entity โ€œwould investโ€ a particular amount in the future as if it is already a verified fact.

Future investment is a projection.
It depends on management decisions, approvals, funding, market conditions and project ex*****on.

CAAS has requested CPCB to discontinue such futuristic CA certification requirements and permit ICAI-compliant formats containing scope, limitations, responsibility clauses and safeguards.

Regulators may demand information.
But professional ethics framed by ICAI, a statutory body under an Act of Parliament, cannot be overridden by one-page formats or administrative convenience.

Status Update | 27th April 2026
On 7th April 2026, the Hon'ble Gujarat High Court had directed CBDT to file an affidavit suggesting remedial measures, noting 11 years of non-compliance with the Court's own 2015 direction to release ITR utilities by 1st April every year.
On 27th April 2026, no affidavit was filed by CBDT. Court noted the "complexity involved in the issues raised" involving "multi-stakeholder, multi-tiered institutional process."
Matter now listed on 23rd June 2026 โ€” after Summer Vacation.
