📋 CAAS vs UOI — SCA/16428/2025
Status Update | 27th April 2026
On 7th April 2026, the Hon'ble Gujarat High Court had directed CBDT to file an affidavit suggesting remedial measures, noting 11 years of non-compliance with the Court's own 2015 direction to release ITR utilities by 1st April every year.
On 27th April 2026, no affidavit was filed by CBDT. Court noted the "complexity involved in the issues raised" involving "multi-stakeholder, multi-tiered institutional process."
Matter now listed on 23rd June 2026 — after Summer Vacation.
Meanwhile:

👉 Portal readiness: Awaited
👉 CBDT's affidavit: Awaited
👉 Compliance with 2015 direction: 11th year running — Awaited

Surat ITAT is carrying 3 times the national average pendency load and is the highest in India.
Nationwide pendency: 44,776 appeals.

CAAS has now moved the Supreme Court with an Intervention Application before the Hon’ble Supreme Court on ITAT vacancies.

Justice delayed is now data-proven.

🚨 BREAKING: Gujarat High Court pulls up CBDT for 11 years of non-compliance with Court directions on timely release of ITR forms & utilities.

Directs CBDT to file affidavit with remedial measures. Warns of "serious view" if not complied.
SCA/16428/2025 | CAAS vs UOI

The Court noted that despite the 2015 direction in AGFTC vs CBDT (SCA/15075/2015) to release forms & utilities by 1st April every year — CBDT has failed to comply for 11 straight years.

As on 7th April 2026: ZERO utilities released. Portal cannot accept a single ITR.

This petition is NOT about due date extension.
It's about:
⚖️ Systemic accountability
⚖️ Portal glitch remediation
⚖️ Waiver of interest/penalty caused by State failure
⚖️ Validation reform (204% increase in 4 years!)
⚖️ Independent technical monitoring

Next hearing: 27th April 2026, TOP OF THE BOARD.
CBDT must file affidavit with concrete measures.

CAAS stands with 4,000+ CAs and the entire taxpaying community. The cycle of annual non-compliance must end.

Important Update on CAAS Writ Petition.

Matter was heard today. Appearing for CAAS were Advocate Dr. Avinash Poddar and Adv. CA Hardik Kakadiya.

With the support and encouragement of Dr. Avinash Poddar, Adv. CA Hardik Kakadiya (President CAAS) in his maiden appearance before any Court, argued the matter in detail. In earlier hearing the matter was marked for dismissal as infructuous, but in today's hearing the opposite party was issued notice to file Affidavit that Glitches are resolved and would not recur.
