On the January 3, 2025, ​Kashmir Law and Justice Project released “'Eyewash': A Human Rights Assessment of US Policy in Kashmir January 1948 - January 1957.” Based on primary analysis of declassified US State Department documents, this report analyzes whether and to what extent US policy on Kashmir during the formative period of US leadership on Kashmir (from January 1, 1948 – January 24, 1957) was consistent with the US’ obligations and commitments under international law.

Across the Global South—spanning South Asia, the Middle East, Africa and beyond—prisons, torture chambers, and state-sanctioned brutality reflect the profound structural legacies of colonialism.

This phenomenon is rooted in the colonial histories of Global South countries, where practices of institutionalised violence were not only inherited from European colonial powers but often embedded into post-colonial governance, police forces and judicial systems—originally designed to suppress colonial subjects.

While the international community professes zero tolerance for torture, its inconsistencies to these regions to distinguish the intensity or severity of pain or suffering warranting the label of ‘torture’ has been opaque in the jurisprudence for the Global South.

The so-called universality of international law has been reduced to geographical outreach. Prohibition and accountability serve imperial and neocolonial agendas, subtly reinforcing Western hegemony.

In the Global South, the structural legacies of colonialism continue to manifest in police highhandedness, torture chambers and state-sanctioned brutality.

The Jammu Massacre of 6th November 1947, led by actors including the Dogra Maharaja Hari Singh, his troops, and Hindu right-wing organizations like Rashtriya Swayamsevak Sangh-RSS, resulted in the tragic loss of 600,000 Kashmiri Muslims and forced migration of half a million to Pakistan. The massacre was a horrendous communal slaughter; as a result of the massacre and migration, Muslims, who were a majority (61 percent) in the Jammu region, became a minority. This heinous war crime warrants retrospective analysis under International Law, in particular the Genocide Convention, 1948, and the Rome Statute of the International Criminal Court, 1998. The international community must provide viable legal redressals to the victims of the Jammu Massacre, including refugees and the living descendants of the victims. Upholding justice is essential, and the foundational issue of Jammu and Kashmir must be resolved in compliance with UNSC Resolutions and the aspirations of the Kashmiri people.
