Previously, in most domestic volence cases, a woman was either thrown out or was forced to walk out of her matrimonial home due to the violence.

The Domestic Violence Act, 2005 provides that an aggrieved woman has the right to stay in her shared household [matrimonial home], whether or not she has a right, title or interest in the same.

On the contrary, through a Magistrate's Protection Order, it is now the male abuser [husband, father, brother, brother-in-law, etc] who can be asked to remove himself from the shared household.
