CASE:

▪️Parties have been living apart since years, and the wife did not return to her matrimonial home, except her brief stay in 2011

▪️It was proven through evidence that the wife had committed cruelty and deserted husband, forcing him to separate from his parents

▪️While the division bench of Justice Rajani Dubey & Justice Amitendra Kishore Prasad dismissed the wife's appeal against the 2019 Family Court order (that granted divorce to husband), the HC also ordered the man to pay one time permanent alimony to "cruel" wife

Businessman Samir Modi, Brother of Arrested For R**e On False Promise of Marriage Charges

CASE:

▪️On Sep 18, Samir Modi, MD of Modi Enterprises, was arrested after landing at Delhi Airport due to an FIR lodged against him at New Friends Colony Police Station under Sections 376 (r**e) & 506 (criminal intimidation) IPC

▪️According to the FIR, the complainant claimed to have been approached by Modi in 2019, on pretext of offering career opportunities in fashion industry

▪️The complainant claims that since 2019, Modi repeatedly r**ed, threatened, assaulted, blackmailed, and cheated her

STATEMENT BY MODI'S COUNSEL

"She claimed to be in a relationship with Samir Modi since 2019. On August 8 and 13, Samir Modi filed complaints before various police officers for extortion and blackmail by the lady. These were supported by the WhatsApp chats between them where she asked for an amount of Rs 50 crore"

▪️R**e FIR was subsequently filed by the complainant on September 10, 2025

VOICE FOR MEN INDIA OPINION:

▪️The adult woman clearly knew that the man she voluntarily entered into a relationship with was "already married", so there cannot be any promise or false promise of marriage

▪️Developing personal relationships on pretext of expecting professional favors in return, is an individual choice, however if the expectations are not met, the failed barter relationship cannot be labelled as "r**e"

▪️The "R**e FIR" being lodged as a counterblast to "Extortion Police Complaints" by Modi also raises serious questions with regards to the motive behind this FIR

REMOVE PROVISION THAT MAKES "GIVING DOWRY A CRIME"

▪️Draft for Dowry Prohibition Kerala Amendment Bill 2025 has been submitted to State Govt by Law Reform Commission to amend the current law

▪️Under current law, giving & receiving dowry is a crime

▪️As per new proposal, only groom or groom’s relatives will be liable for criminal offence if they receive dowry

▪️The reason given for this amendment is that women & their families who give dowry are the ones who are harassed & despite the harassment they don't file complaint due to fear of legal action against them
