The end game of triple talaq

The new executive order, approved by the cabinet of Prime Minister Modi, calls for a jail term of up to three years for a "Muslim" husband using the practice for divorce

Firstly, when the practice has been held invalid by the highest court of the nation, how can the practice be criminalized.

Why is there a need for an executive order when there is a precedent of the strongest stature available for the recourse of women.

Secondly, why is there discriminatory application of the principles upon which this legislation is based.
The effect of Triple talaq is no different than that of desertion by Hindu men. How can a democratic government set rules in place to target one community for actions whose effect is exercised by men spanned over all religious, cultural and societal practices.

If the idea is to protect Muslim women's rights, an issue that has sufficient and well equipped laws in place, does criminalizing the practice really do them any benefit?

Rather than enacting a UCC, the Law Commission has recommended that family laws of every religion must be reformed to render them gender-just.

What started in the 80s as a study in the field of women undergoing violence and women in law, has inspired a women's rights movement that holds strong ground till date. Today, we're a team of women comprising of social workers, lawyers and activists with an agenda for social and legal change. Our agenda, to evolve gender just ideologies and practices in society.
The Centre based in Mumbai brings together individual experiences and expertise to provide access to justice to women and children across class, more particularly to those who come from marginalized sections.

Transforming a victim into a survivor is a long drawn process. Despite of several hurdles in the way, we ensure we walk hand in hand with our fellow women. Their journey becomes ours. In this process, we help them overcome their vulnerabilities and attain their goals and aspirations beyond their case. After having walked through this intimidating system together, we see the emergence of a survivor.

The team at Majlis is very pleased to inform you that the Law Commission, in its report dated 31st August '18 on Family Law Reform, addressing matters in relation to the adoption of a Uniform Civil Code, took the stand that we as a women's rights organisation have endorsed for over two decades. We reaffirm our stance that what we need moving forward are gender just reforms within personal laws.

In the Report, the Law Commission has stated that a Uniform Civil Code is neither feasible or desirable for a diverse and pluralistic country like India.

This is a major victory for women's rights and diversity.

Rather than imposing an overarching uniform code, gender unjust practices within communities have to be examined carefully and changed by either involving the community or through judicial interventions. Though this process is gradual and tedious, only this process can lead to effective change where women feel comfortable to enforce their constitutional rights of equality.

We at Majlis believe that establishing a uniform civil code will take away the protective legislations enacted as amendments to personal laws over the years to protect the rights of minorities. Reform by judicial intervention is far more acceptable to people than imposing a Uniform Civil Code through legislative intervention.

While we continue to raise awareness about available rights and reliefs and work towards empowering women within the patriarchal, societal, political and legal framework to enable better access to courts and other legal enforcement mechanisms, we will continue to analyse the concept of uniformity of rights through a woman’s agency and autonomy to negotiate for equal rights within this system.

Majlis, in collaboration with the Muslim Women's Forum, organized the "Muslim Women Rights and Reality - Charting out an action program" on the 24th of August '18 after the successful initial round table held in Delhi in July.

We'd like to share with you the progress we've made during these talks, including reaching a collective consensus on initiatives to build peace and harmony on the ground and our commitment to continued interventions to secure rights of Muslim women. In discussing the challenges faced due to marginalization, state repression and concerns that Muslim women face, we collectively pledge to work towards creating a just reality.

Flavia Agnes' latest article "India’s Church: Mired in controversies" talks about issues in India's churches that are often far from the spotlight, or quickly covered up and forgotten about if they are ever brought forward. Sexual violence and the sale of children perpetrated by nuns is something that is shocking, but "is serious and needs to be investigated thoroughly, beyond the political rhetoric," in the words of Flavia Agnes herself.

"Section 377 needs to go: A ‘Victorian relic’ has no place in today’s India" by Flavia Agnes is an extremely meticulous and detailed article digging into the intricacies and history of events on Section 377. The article in Asian Age looks at the arguments for and against repealing the section, and leaves us with food for thought.

The court left it to Parliament to consider deleting the provision.

A walk down the memory lane

When the young and vivacious Flavia Agnes was caught in the whirlpool of marital troubles, she understood the reality of being a woman.

In 1981 she began an expedition with a group of women to ensure that hesitant voices suffering from violence did not go unheard, in search for a medium to empower women.

This is her story, of rebuilding broken lives.
