AIITEU Observes a Black Day on April 1, 2026, with Aggrieved Employees of TCTS

AIITEU stands in solidarity with the Joint Platform of Central Trade Unions in observing a Black Day on April 1, 2026, to protest against the draconian labour codes that threaten the fundamental rights of IT
Employees in India.

As part of our protest and campaigns in regard to the Black Day observance, AIITEU members of Maharashtra State Chapter along with aggrieved IT Professionals of Tata Communications Transformation Services (TCTS), lodged a high volume of complaints at the Mumbai Labour Commissioner’s office. In workplaces like TCTS, employees face coercion and denial of severance packages regularly. The pro-employer labour codes shall only extend the horizon for such malpractices while the employees’ plight will continue unabated.

AIITEU shall continue to raise its voice against the labour codes. The labour codes should be scrapped without further ado to protect the workers' rights to live with dignity alongside their inherent right to collective bargaining under a valid employment contract.

On March 17, 2026, a massive nine-judge Constitution Bench, led by Chief Justice Surya Kant, began hearing arguments to redefine a single, powerful word: “Industry”. The arguments have concluded today and the judgement has been reserved which means the Hon’ble Supreme Court shall ponder further on the arguments made by the the parties and pronounce the judgement at a later date.

For nearly 50 years, the 1978 Bangalore Water Supply case has been the ruling standard that established the “Triple Test”: if an organisation performs a systematic activity, through cooperation between employers and employees and produces goods or services, it’s an industry—even if it doesn’t make a profit. This broad view currently protects workers in hospitals, universities, and even charitable trusts under the Industrial Disputes Act of 1947.

But now, the government and various employers are pushing back. They argue the definition is “excessively wide” and causing confusion. The Attorney General of India, suggested using the 2020 Industrial Relations Code as a guide to narrow the scope, arguing that sovereign functions and social welfare schemes should be exempt from labour laws.

On the other side, Senior Advocate Indira Jaising delivered a powerful counter-argument questioning how a charitable institution can claim to serve the world while refusing to pay its own workers a fair wage. She argued that whether a worker is making laddus in a temple or cleaning a courtroom, their labour remains the same and deserves protection.

AIITEU shall track this case and take necessary steps to safeguard the interests of IT employees in the country at any cost.

The Supreme Court of India has constituted a nine-judge Constitution Bench to reconsider the definition of “industry” under Section 2(j) of the Industrial Disputes Act, 1947. The hearing is scheduled for March 17–18, 2026, and is expected to address a legal question that has remained unresolved for more than two decades.

For many years, employers—particularly government bodies, have argued that the broad interpretation of “industry” creates uncertainty about which labour laws apply to their employees. A clearer definition could provide greater certainty regarding legal compliance and liability.

However, if the definition is significantly narrowed, it could exclude large sections of workers from the protections available under the Industrial Disputes framework, potentially affecting millions of workers across India.

All India IT & ITeS Employees’ Union (AIITEU) participated in a Pan-India Protest in support of the historic All India General Strike convened by the Joint Platform of Central Trade Unions and CITU on 12 Feb 2026. Standing shoulder to shoulder with IT/ITeS workers from Kolkata, Durgapur, Mumbai, Ahmedabad, Hubli and other cities, AIITEU reaffirmed its uncompromising opposition to the draconian, anti-worker Labour Codes imposed by the BJP-led Central Government.

These Labour Codes seek to dilute hard-won rights, weaken collective bargaining, extend working hours, and make hire-and-fire the new normal. Under the guise of “reforms,” these laws erode job security, undermine trade union rights, and attack the fundamental right to live and work with dignity.

AIITEU’s participation in the strike sends a clear message:

The IT/ITeS workforce will not remain silent spectators while labour protections are dismantled. We stand united with the broader working class in demanding the unconditional scrapping of the anti-worker Labour Codes and the restoration and strengthening of labour rights.

Celebrating the Foundation Day of the All India IT and ITeS Employees’ Union (AIITEU)

The All India IT and ITeS Employees’ Union (AIITEU) has been playing a pivotal role in defending the rights and dignity of IT and ITeS professionals across India. At a time when pan-India corporates and multinational companies continue to subject working professionals to inhumane exploitation—marked by prolonged working hours, severe health hazards, and the violation of the fundamental right to live with dignity—AIITEU stands as a vital refuge for workers.

AIITEU’s Statement on TCS Layoffs

The All India IT and ITeS Employees’ Union (AIITEU) condemns the forced resignation and illegal retrenchment carried out by Tata Consultancy Services (TCS). TCS can no longer disguise the grim reality of mass layoffs under the pretext of organisational restructuring. Despite recording a net profit of ₹65,331 crore in FY 2024–25, TCS initiated a sweeping downsizing program following its new “associate deployment policy” announced on June 12, 2025. This policy, which imposed a minimum billability of 225 days and restricted bench time to 35 days annually, triggered fears of large-scale job losses—fears later validated when TCS’s CEO confirmed a 2% workforce reduction. Our findings reveal a far deeper crisis. Contrary to the official claim, the union estimates that over 38,000 employees were effectively forced out, either through coercive resignations or veiled threats. Reports from affected employees describe closed-door meetings, intimidation, and psychological harassment. Many were compelled to resign under duress, denied due severance, and stripped of health insurance without notice—violating both the Industrial Disputes Act of 1947 and Article 21 of the Indian Constitution, which guarantees the right to live with dignity.
AIITEU holds firmly that the government’s silence has acted as a complicit factor while TCS’s actions reflect a dangerous precedent where corporate priorities override workers’ rights. The “mutual separation” packages developed by TCS are inconsistent and discriminatory that benefit only a select few, while leaving the majority financially and emotionally devastated. July to September quarter witnessed a nationwide agitation with employees staging protests in major cities and social media amplifying their cause through trending campaigns like and . AIITEU has filed multiple complaints across regional labour offices and calls for immediate governmental intervention, demanding a tripartite meeting between the state, TCS management, and employees.
In conclusion, the union asserts that the TCS layoffs represent a systematic assault on the fundamental rights of India’s skilled workforce. It urges the policymakers to restore constitutional balance by ensuring corporate accountability, protecting labour rights, and preventing such exploitative practices from becoming normalized within India’s IT/ITeS ecosystem.
